HomeMy WebLinkAboutAgenda Item Summary FormAGENDA ITEM SUMMARY FORM File ID: #14575 Date: 09/05/2023 Commission Meeting Date: 09/14/2023 Requesting Department: Department of Resilience and Public Works Sponsored By: Joe Carollo District Impacted: District 1, District 2, District 3, District 5 Type: Resolution Subject: Authorize Agreement - Miami River Fund, Inc Purpose of Item: A resolution of the Miami City Commission, with attachment(s), authorizing the City Manager to execute an agreement with the Miami River Fund, Inc., the Financial Agency for the Miami River Commission, pursuant to Section 18-112 of the Code of the City of Miami, Florida, as amended ("City Code"), to provide landscape maintenance services, litter and debris pickup and other services to maintain the Miami River Greenway at specified City rights of ways, for the City of Miami ("City") Department of Resilience and Public Works ("RPW') as described in Exhibit "A", for a two (2) year term, with an option to renew for one (1) additional one (1) year period, commencing upon execution of the agreement, in an annual amount not to exceed $315,000.00, for a total amount not to exceed $945,000.00; allocating funds from Account No. 13000.201000.534000.0000.00000, subject to the availability of funds and prior budgetary approval; further authorizing the City Manager to negotiate and execute any and all other documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Background of Item: The City of Miami and Miami River Commission ("MRC") have an interest in the health and cleanliness of the Miami River Greenway. The MRC was established by Section 163.06, Florida Statutes, as the official clearinghouse for all public policy and projects related to the Miami River and is funded by the Florida Department of State, Florida Department of Transportation, Miami -Dade County, the City, and private sector donations. Section 18-112 of the Code of the City of Miami, Florida, as amended, authorizes the City to enter into an agreement with state funded institutions for the purchase or acquisition of goods or services without competitive bidding procedures subject to City Commission approval for purchases over $50,000.00. Located along the Miami River lies a 6.2-mile public pedestrian and bicycle trail. The trail is a riverwalk directly along the shoreline where feasible and continues around neighborhoods and marine industrial as an on -road greenway. The path features landscaping, way -finding signs, historical markers, information kiosks, art installations, decorative lighting, benches and other great amenities for residents, commuters and tourists. RPW requires regularly scheduled landscaping services for the greenery along the trail and the Miami River Fund will provide regularly scheduled landscaping services. The annual cost of services will have a value of $315,000.00 ($945,000.00 in the aggregate). The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to negotiate and execute an agreement, in a form acceptable to the City Attorney, with Miami River Fund, Inc., a Florida not - for -profit 501(c)(3) corporation, as the financial agency for the MRC, to provide the Services to maintain the Miami River Greenway in City ROW for a two (2) year term, with an option to renew for one (1) additional one (1) year period, in an amount not to exceed three hundred fifteen thousand dollars ($315,000.00) annually. Section 3. Funds are hereby allocated from Special Revenue Account No. 13000.201000.534000.0000.00000 for said purpose, subject to the availability of funds and prior budgetary approval. Section 4. The City Manager is further authorized1 to negotiate and execute any and all other documents, including any amendments, renewals, and extensions, all in forms acceptable to the City Attorney, as may be deemed necessary for said purpose, subject to all allocations, appropriations, and prior budgetary approvals, and in compliance with all applicable provisions of the City Code, and in compliance with all applicable laws, rules, and regulations. Section 5. This Resolution shall become effective immediately upon its adoption.
