each of the 2023-2024 and 2024-2025 fiscal years, as specified in exhibit "a", subject to
the availability of funding, to provide housing quality standard inspection services for the
city of Miami's section 8 housing choice voucher and moderate rehabilitation programs
and housing opportunities for persons with aids program; further authorizing the city
manager to execute any and all the necessary agreements, in a form acceptable to the
city attorney, with said agencies, for said purpose.
Background of Item:
The Department of Housing and Community Development ("Department") receives
diverse types of repayments from loans provided to developers and homeowners
("Program Income") that are required to be used for eligible program activities.
From May 1, 2023, to July 31, 2023, the Department collected an amount of
$138,720.89 in Community Development Block Grant ("CDBG") Program Income.
Pursuant to CDBG regulations 24 CFR Part 570.504, program income must be used for
eligible CDBG activities.
The Department recommends allocating the Funds to the activities specified in Exhibit
"A" attached and incorporated, which are eligible CDBG activities.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT
("CDBG") ADMINISTRATION AND HOUSING OPPORTUNITIES FOR PERSONS
WITH AIDS ("HOPWA") PROGRAM DELIVERY FUNDS TO ALLAPATTAH BUSINESS
DEVELOPMENT AUTHORITY, INC. AND SUNSHINE FOR ALL, INC. FOR EACH OF
THE 2023-2024 AND 2024-2025 FISCAL YEARS AS SPECIFIED IN EXHIBIT "A,"
SUBJECT TO THE AVAILABILITY OF FUNDING, TO PROVIDE HOUSING QUALITY
STANDARD INSPECTION SERVICES FOR THE CITY OF MIAMI'S SECTION 8
HOUSING CHOICE VOUCHER AND MODERATE REHABILITATION PROGRAMS
AND HOPWA PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO
EXECUTE ANY AND ALL THE NECESSARY AGREEMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH SAID AGENCIES, FOR SAID
PURPOSE.
WHEREAS, the City of Miami ("City") receives funding from the United States
Department of Housing and Urban Development ("HUD") for its Section 8 programs and
Housing Opportunities for Persons with AIDS ("HOPWA") program (collectively, "Programs");
and
WHEREAS, the Programs require that all applicable properties be inspected during
move -in and move -out and annually to meet minimum housing quality standards; and
WHEREAS, the City's Department of Housing and Community Development issued a
Request for Proposal ("RFP") for qualified and experienced firms for general inspection
services, including but not limited to Housing Quality Standard Inspections, in accordance with
the requirements of 25 CFR 982.401, Housing Quality Standards ("HQS") Handbook 7420.3 as
well other type of inspections in accordance with, when applicable, the governing Florida
Building Code and other federal, state, and local laws, rules, regulations, directives, codes and
ordinances; and
WHEREAS, the RFP was issued on February 6, 2023, with a submission deadline of
March 6, 2023; and
WHEREAS, the RFP produced a total of two (2) proposals of which both qualified
applicants are being considered for funding; and
WHEREAS, Allapattah Business Development Authority, Inc. ("ABDA") and Sunshine for
All, Inc. are private nonprofit Sub -recipients as defined under the provisions of 24 CFR
570.500(c), eligible to receive Community Development Block Grant ("CDBG") funding
assistance from the City to undertake activities eligible for such assistance under Subpart C of
the regulations; and
WHEREAS, the City's Administration recommends the transfer of CDBG administration
and HOPWA program delivery funds as specified in Exhibit "A," attached and incorporated, to
provide HQS inspection services for the City's Programs for 2023-24 and 2024-25 program
years, subject to availability of funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The transfer of CDBG administration and HOPWA program delivery funds to
ABDA and Sunshine for All, Inc. as specified in Exhibit "A," attached and incorporated, to
provide HQS inspection services for the City's Programs, for the 2023-2024 and 2024-2025
program years, subject to the availability of funds, is authorized.'
Section 3. The City Manager is authorized' to negotiate and execute any and all
necessary documents, including amendments, extensions, and modifications, all in forms
acceptable to the City Attorney for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption.
