Subject: Donation - Sculptures at City of Miami Park
Purpose of Item:
The nature of this item is to authorize a resolution of the Miami City Commission,
authorizing the City Manager to accept a donation from WMP I LLC, a Florida Limited
Liability Company ("Donor"), to the City of Miami's Parks and Recreation Department
("Parks"), in the form of three (3) sculptures with an approximate value of nineteen
thousand one hundred sixty-seven dollars with zero cents ($19,167.00) per sculpture
and a combined value of fifty-seven thousand five hundred and one dollars with zero
cents ($57,501.00); Further authorizing the City Manager to execute a donation letter of
acceptance and/or Agreement all in a form acceptable to the City Attorney, and in
compliance with all applicable laws, rules, and regulations, as may be deemed
necessary for said purpose.
Background of Item:
The Parks Department is responsible for the upkeep and beautification of various parks
in the City. As part of their beautification plan, Parks display works of art at its various
Parks for the residents to enjoy. In support of Parks' plan to display works of art, the
Donor wishes to donate three (3) sculptures to the Parks Department. The sculptures
have a combined value of fifty-seven thousand five hundred and one dollars with zero
cents ($57,501.00) and will be displayed in the vicinity of South Bayshore Drive in
Coconut Grove.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO ACCEPT A DONATION FROM WMP I LLC, A FLORIDA LIMITED
LIABILITY COMPANY ("DONOR"), TO THE CITY OF MIAMI ("CITY") PARKS AND
RECREATION DEPARTMENT ("PARKS"), IN THE FORM OF THREE (3)
SCULPTURES, WITH AN APPROXIMATE VALUE OF NINETEEN THOUSAND ONE
HUNDRED SIXTY SEVEN DOLLARS ($19,167.00) PER SCULPTURE, AND AN
APPROXIMATE COMBINED VALUE OF FIFTY SEVEN THOUSAND FIVE HUNDRED
ONE DOLLARS ($57,501.00), ALLOWING FOR DISPLAY OF THE ART IN PUBLIC
PLACES; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A
DONATION LETTER OF ACCEPTANCE AND/OR AGREEMENT, ALL IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
DOCUMENTS, INCLUDING ANY AMENDMENTS AND MODIFICATIONS, SUBJECT
TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS,
COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING THE CITY'S
PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL
INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY
CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE
WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED
NECESSARY FOR SAID PURPOSE.
WHEREAS, WMP I LLC, a Florida limited liability company ("Donor"), wishes to donate
three (3) sculptures to the City of Miami ("City"), with an approximate value of Nineteen
Thousand One Hundred Sixty Seven Dollars ($19,167.00) per sculpture, and an approximate
combined value of Fifty Seven Thousand Five Hundred One Dollars ($57,501.00), allowing for
display of the art in public places; and
WHEREAS, the City's Parks and Recreation Department ("Parks") will display said
sculptures on South Bayshore Drive in the Coconut Grove vicinity; and
WHEREAS, Parks will eventually transport the sculptures to a new permanent location
and will ensure proper installation as required; and
WHEREAS, the acceptance of this donation will be beneficial to the City by contributing
to the Park's plan for beautifying open spaces by displaying works of art on its premises for all
patrons to enjoy;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to accept a donation from the Donor, to
Parks, in the form of three (3) sculptures, with an approximate value of Nineteen Thousand One
Hundred Sixty Seven Dollars ($19,167.00) per sculpture, and an approximate combined value
of Fifty Seven Thousand Five Hundred One Dollars ($57,501.00), allowing for display of the art
in public places.
Section 3. The City Manager is hereby further authorized' to execute a donation letter of
acceptance and/or agreement, all in a form acceptable to the City Attorney, for said purpose.
Section 4. The City Manager is hereby further authorized' to negotiate and execute any
and all documents, including any amendments and modifications, subject to all allocations,
appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code
of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement
Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18
of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable
laws, rules, and regulations, as may be deemed necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
