HomeMy WebLinkAboutR-23-0369City of Miami Resolution R-23-0369 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14471 Final Action Date: 9/9/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING AND ADOPTING THE ANNUAL BUDGET OF THE CIVILIAN INVESTIGATIVE PANEL, ATTACHED AND INCORPORATED AS EXHIBIT "A," IN THE TOTAL AMOUNT OF $ 1,390,000.00 FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2023, AND ENDING SEPTEMBER 30, 2024. WHEREAS, the City of Miami ("City") Civilian Investigative Panel ("CIP") was created pursuant to Ordinance No. 12188 on February 14, 2002, as amended by Ordinance No. 12315, adopted on January 23, 2003; Ordinance No. 12379, adopted on June 12, 2003; Ordinance No. 13186, adopted June 24, 2010; Ordinance No. 13688, adopted on June 8, 2017; and Ordinance No. 13719, adopted December 14, 2017; and WHEREAS, pursuant to Section 51 of the Charter of the City of Miami, Florida, as amended ("Charter") and Chapter 11.5, Article II of the Code of the City of Miami, Florida, as amended ("City Code"), the CIP serves as an independent citizens' oversight panel with authority to conduct investigations and propose recommendations regarding allegations of misconduct by any sworn officer of the City's Police Department ("MPD"), make written recommendations related to MPD policies and procedures, and subpoena witnesses and documents when conducting independent investigations of allegations of police misconduct; and WHEREAS, Section 11.5-35 of the City Code provides that the CIP shall be operated on an annual budget that shall be no less than one percent (1 %) of the approved regular salaries and wages line item for the MPD's general fund budget except as otherwise required by the City Manager'sdeclaration of a fiscal emergency, financial urgency, or financial emergency; and WHEREAS, the CIP reviewed and approved its budget for Fiscal Year 2023- 2024 on July 18, 2023 in the total amount of $1,390,000.00, attached and incorporated in Exhibit "A"; and WHEREAS, the CIP requests the approval by the Miami City Commission of its budget for the Fiscal Year commencing October 1, 2023, and ending September 30, 2024, in the total amount of $1,390,000.00, attached and incorporated in Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.
