MW MW EW m- w aimiv m- m mm- mv m m- ism mmw MEW mmw momm MEW Ent MEW N E▪ W mmw imE Errt MM- ME MRt WM N▪ NW WW MEW WW MIEW ME ft ORDINANCE NO, AN ORDINANCE SETTING FORTH A PROPOSED CHARTER AMENDMENT AMENDING SECTIONS 4 (a) , 4 (b) AND 13(b) OF THE CHARTER OF THE CITY OF MIAiMI TO PROVIDE POR AN ENLARGED CITY COMMISSION FROM FIVE TO NINE MEMBERS WITH THE• FOUR ADDITIONAL CITY COMMISSIONERS TO BE ELECTED FROM FOUR DISTRICTS BEGINNING WITH THE 1979 REGULAR MUNICIPAL ELECTION; PROVIDING FOR A METHOD OF ESTABLISHING THE SAID DISTRICTS; PRO- VIDING FOR A FOUR YEAR TERM OF OFFICE FOR SAID ADDITIONAL COMMISSIONERS; SUBMITTING THE PROPOSED CHARTER AMENDMENT TO THE ELECTORS OF TIIE CITY OF MIAtMI AT THE SPECIAL MUNICIPAL ELECTION OF OCTO- BER 5, 1978; PROVIDING THAT THIS CHARTER AMENDMENT SHALL BE REFERRED TO AS "PROPOSED MIAMI CHARTER AMENDMENT NO. 1"; REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONFICT; AND CONTAIN- ING A SEVERABILITY PROVISION. WHEREAS, the population composition of the City of Miami has changed substantially over the past 20 years; and WHEREAS, it is desirable to provide opportunities for more people to participate directly in the affairs of local government; and WHEREAS, the Board of County Commissioners for Dade County, r Florida, must app ve the ballot form of any charter amendment question prior on(ie ballot; NOW, THEREFORE, BE ITADAINED BY THE COMMISSION OF THE t placement i CITY OF MIAMI, FLORIDA: Section 1. The Ci ommission of the City of Miami hereby submits (� d following p?oposed charter amendment for submission to the el ctors of the City of Miami at the Special Municipal Election of 0etotdr 5, 1978, to become effective upon its approval by the - electors: CHARTER AMENDMENT NO . 1 Suctions 4(a), 4(b) and 130) of the City of Miami Charter, Chapter 10847, Special Acts, Laws of Florida, ].925, as amended, are 1/ horeby further amended in the following particulars: "Section 4. Form of government. (a) General description. --The form of government of the City of Miami, Florida, provided for under this Words and/or figures stricken through shall be deleted. Asterisks indicate omitted attd unchanged material. • IiE ENE MEM MEE Charter shall be known as the *Cohttnission Manager Ptah', and the r_otlmissiot: shall consist of fikie-4 tiinc (9) citizens' who ate qualified voters of the city and! five (5) who shall be elected at large in manner hereinafter provided z four (4), who shall be elected by district in manner hereinafter provided. * * * (b) Election of commission; terms of office; recall -, The commission shall consist of fine nine members five, who shall be elected from the city at large in groups numbered one through five; and four, who shall be elected from districts designated "A" through "D". One of the said commissioners elected at large shall be the mayor and shall be elected by the people from the group to be numbered I and all persons desiring to qualify as candidate for mayor shall file in Group I. * * * All persons desiring to qualify for commissioners to he elected at large shall file in groups numbered II through V. All persons desiring to qualify for com- missioners to be elected by district shall file in groups designated "A" through "D". * * * Four (4) commissioners shall be elected from one of each of four (4) districts designated "A", "B", "C" and "D". Any person desiring to qualify for the office of commissioner elected by district must be a resident of the designated district in which he is seeking to qualify. The initialgeographic boundaries of the four (4) districts designated '"A", "B", "C" and "D" shall be established by the city commission on or before May 1, 1979, based upon study and recommendations from the city manager and the director of the planning department. District boundaries shall be established so that all districts are as nearly equal in population and are arranged in a logical and compact geographic pattern to the extent possible. Within six (6) months after pub- lication of each official federal census of Dade County, the city commission shall review the geographic bound- aries of the four (4) designated districts herein in order to insure that all districts are as nearly equal in population as practicable. After the initial estab- lishment of the aforesaid districts, there will be an election of the four (4) commissioners from the desig- nated districts at the regular municipal election in November, 1979. Commissioners elected from districts "A" and "B" shall be elected first for a two (2) year term and thereafter for four (4) year terms. Commissioners elected from districts "C" and "D" shall be elected first for a four (4) year term and thereafter for four (4) year terms. * * Vacancies shall be filled as provided in section 13(a) of the Charter of the City of Miami except that a vacancy occurring in the office of a commissioner elected by district shall only be filled by a person residing within the designated district where the vacancy arose. * * * "Section 13-F3s Eiection when terms of four eight or Mote commissioners expire simultaneously, Where the terms of fatty eight or more commissioners expire simultaneously at one general election, then the number of commissioners required to constitute n comtnission of ffae nine members shall be elected for the terms of office prescribed by section 4 of the Charter of the City of Miami.
