A RESOLUTION ACCEPTING THE BID OF DELTA
PAINTING CORPORATION IN THE AMOUNT OW
$19,950,00 FOR THE ORANGE BOWL - UPPER
DECK = TRAFFIC BEARING SEAL COAT; WITH
FUNDS ALLOCATED FROM THE ACCOUNT ENTITLED
"ORANGE BOWL ENTERPRISE FUND" IN THE AMOUNT
OF $19,950,00 TO COVER THE CONTRACT COST;
ALLOCATING FROM SAID FUND THE AMOUNT OP
$2,194.00 TO COVER THE COST OF PROJECT
EXPENSE; ALLOCATING FROM SAID FUND THE
AMOUNT OF $399.00 TO COVER THE COST OF
SUCH ITEMS AS ADVERTISING, TESTING
LABORATORIES, AND POSTAGE; AND AUTHORIZING
THE CITY MANAGER TO EXECUTE A CONTRACT WITH
SAID FIRLR
WHEREAS, sealed bids were received July 12, 1978
for the ORANGE BOWL - UPPER DECK - TRAFFIC BEARING SEAL
COAT; and
WHEREAS, the City Manager reports that the $19,950.00
bid of Delta Painting; Corporation is the lowest responsible
bid and recommends that a Contract be awarded to said firm;
and
WHEREAS, the proposed amount of the Contract is to
be allocated from the account entitled "Orange Bowl Enterprise
Fund";

Section 1. The July 12, 1978 bid of Delta. Pa nting
Corporation in the proposed amount of $19,950.00 for the
project entitled ORANGE BOWL - UPPER DECK - TRAFFIC BEARING
SEAL COAT, namely Base Bid of the Proposal, is hereby accepted
at the price stated therein.
Section 2. The amount of $19,950.00 be, and it is
hereby, allocated from the account entitled "Orange Bowl
Enterprise Fund" to cover the cost of said Contract.
Section 3. The amount of $2,1941.00 is hereby allocated
from the aforesaid Fund to cover the cost of Project Expense.

is located in the south upper deck of ehe Orange Bowl,
1400 N.W. 4th Street, Miami, Florida.

All bids shall be submitted in accordance with the Instruc-
tions to Bidders and Specifications. Plans and Specifica-
tions may be obtained from the Office of the Director
Department of Public Works, 3332 Pan American Dirve, Miami,
Florida. Plans and Specifications are to be returned in
good order and unmarked within 10 days after Bids have
been received.
Those minority or target area contractors/small businesses
interested in submitting bids are advised to contact
Contractors Training and Development, Inc. for providing
technical assistance in putting together bid packages.
For further information pertaining to the above, call
Mr. James D. Thomas, Administrative Assistant, at 579-6848.
Proposal includes the time of performance and Specifications
contain provisions for liquidated damages for failure to

first 20 mil coat or Chem-Elast 2816, (waterproofing
membrane) or equal, which will be allowed to dry a
minimum of twenty-four (24) hours."

Storm Sewers are now placed in two divisions in the "Standard
Contract Documents and Specifications for Public Works
Improvements," Edition of Octoter 1969, Revised to date;
namely Construction Materials and Construction Methods.
The General Conditions, Construction Materials and Construction
Methods will not be duplicated ir. the Bidders' copies of the
specifications for a specific project. It will therefore to
necessary for you to acquire a set of Standard Contract
Documents and Specifications when working up a bid or doing
the actual construction work.
This book will be available to you at this office when you
pick up plans and specifications for a project of the type
noted in the first paragraph. The price is $4.CC.

STARTING AND CONSTRUCTION TIMES:
The Bidder agrees to start work within five (5) consecutive
calendar days after date of written notice from the Engineer
to begin work. The work may be started on any working day
within this five (5) consecutive calendar day periods The
Bidder shall complete the Contract in accordance with the
Plans and Specifications therefor, within ten (10) working
days, and this time is of the essence. The ten (10) working
day period shall begin on the first working day after the
above noted 5th calendar da.y. All work shall be in full and
complete accordance with all terms and conditions set forth
in and covered by the Contract Documents,
NOTE: CONTRACTOR'S SUPERINTENDENT ON 24-HOUR CALL. In the event
that the Engineer must contact the Contractor to perform emergency
repair work to correct hazardous or unsafe conditions or problems
relating to public health or welfare as a result of or associated

1. SUBMISSION OF PROPOSALS: Submit Proposal on the Pro,rosa1,
Form as furnished in the Bidder's envelope, together with a
Bid Security, as described in Item 6, next page, A ;mire
Proposal Form is furnished for Bidder to retain for ht.:
file copy. DO NOT USE PROPOSAL FORM IN BOUND SPECrr IA-
TIONS. Submit the Proposal and Bid Security in the cnv'•lope
provided, which shall be sealed and marked so as to clearly
indicate its contents and the name of the Bidder.
(a) If forwarded by mail, the abovementioned envelope
shall be addressed to the City Commission, c/o City Clerk,
City of Miami, City Hall, 3500 Pan American Drive, Miami,
Florida 33133, and sent by registered mail, to arrive an;;
time prior to 5:00 P.M. of the last working day precediAg
the date for opening of Bids, as stated in the Advertise-
ment for Bids.
(b) If forwarded other than by mail at any time prior
to the date for opening of Bids, it shall be delivered to
the City Clerk at the above location.
(c) If delivered on the date of opening of Bids, it
shall be delivered to the City Clerk at the location and
on the date and prior to the time, all as stated in the
Advertisement for Bids.
2. LICENSES: As a prerequisite to the submi:;ion of a Bid,
the Bidder shall hold a valid Certificate Df Competency
issued by the appropriate examining board of Metropolitan
Dade County.
As a prerequisite to the signing of a Contract, the
Bidder and all his listed Subcontractor, shall hold a current
County Municipal Occupational License a:; issued by Metro-
politan Dade County for the performance of work in the City
of Miami.
All Bidders shall investigate the necessity of com-
pliance with the requirements of the Florida Construction
Industry Licensing Board, which fixes registration and
certification procedures by the State of Florida.
3. ONE PROPOSAL: Only one Proposal from an individual farm,
partnership, or corporation under the same or different
names will be considered. If it Jr, believed that a Bidder
is interested in more than one Proposal for the work
involved, all Proposals in which such a Bidder is interest
will be rejected.
!i. PRICE BID: The price bid for each item ::hall be stated In
both words and figures in the appropriate places In the
Proposal form. In the event that there is a discrepancy
between the price written in words and the price written
in figures, the former shall govern. In case of error in
the extension of prices, the unit price will govern.

6. BID SECURITY: Each Propoual shall be accompanied by a
Bid Security which may be a Certified Check or a Bid
Bond.
The Bid Security shall be not less than five per--
cent5%) of the amount of the Bid, except Projects
identified as a Local Improvement a, defined by the City
Charter. The Bid Security for Local Improvements shall
be not less than two and one-half percent (2-1/2%) of
the amount of the Bid.
If a Bid Bond is furnished, it shall be on the
form provided and signed by a licensed agent of the
State cf Florida as Attorney -in -Fact for the company
writing :ame, and written by a properly licensed
insurance agent located in Dade County. A
Bid Bond must be accompanied by an affidavit, executed
by a qualified officer of the company tendering such
bond or by the Attorney -in -Fact of suoh company, setting
forth the amount of capital and the amount of surplus
held by said surety company as of the last publiuhed
report. The Attorney -in -Fact, or other offier who signs
a Bid Bond for a surety company, must file with such
Bond, a copy of his power of attorney authorizing him
to do ^c. The address and telephone number of the
local representative of the surety company furnishing
the Bid Bond shall be inscribed on the certificate
furnished to the City.
The City of Miami reserves the right to reject any
and al.l :::lr'.'ty tendered to the City. Certified Checks
will be returned within ten (10) days after the City of
Miami and the accepted Bidder have executed the written
contract and the accepted Bidder has filed an acceptable
Performance Bond. If sixty (60) days have passed after
the date of the formal opening of the bids, and no
contract has been awarded, the Certified Checks of all
Bidders will be returned on demand.
7. BID SECURITY FORFEITED LIQUIDATED DAMAGES: Failure to
execute a Contract and file an acceptable Performance
Bond, as provided herein, within ten (10) days after written
notice of award has been given,shall be just cause for the
Revision of November, 1973

annulment of the award and the forfeiture of the Rid
seourity to the City of Miam', Florida, which forfeiture
ihall be considered, not as a penalty, but in liquidation of
damages sustained. Award may tt,en be made to the next
lowest responsible Bidder or all bids may be rejected.
8. HIOHT TO ACCEPT OR REJECT PROPOSALS: Proposals which are
incomplete, unbalanced, conditional, obscure, or which
contain additions not requested, or irregularities of any
kind, or which do not comply in every respect with the
Instructions to Bidders and all other Contract Documents,
may be rejected at the option of the City Manager. The City
Commission reserves the right to reject any cr all Proposals,
or any part of any Proposal, to waive any informality in any
Proposal, or to re -advertise for all or any part of the work
contemplated on Projects identified as Local Improvements
by the City Charter.
9. WITHDRAWAL OF PROPOSAL: Any Proposal may be withdrawn prior
to the time scheduled in the Advertisement for Bids for the
opening thereof. A Proposal may also be withdrawn if sixty
(60) days have passed after the date of opening the Pro-
posals, provided that a Resolution accepting said Proposal
has not been adopted by the Commission of the City of Miami.
10. AWARD OF CONTRACT: Written notice will be given to the
lowest responsible Bidder, upon acceptance of his Proposal
and the award of the Contract to him.
If the Bidder to whom the Contract is awarded forfeits
his Bid Security, and the award of the Contract is annuled,
the City Commission may then award the Contract to the next'
lowers. responsible Bidder, or the work may be re -advertised,
or may be constructed by day labor, as the City Commission
decides.
11. INTERPRETATION OF CONTRACT DOCUMENTS: Each Bidder shall
thoroughly examine the Contract Documents, and judge for
himself all matters relating to the location and the charac-
ter of the proposed work. If the Bidder should be of the
opinion that the meaning of any part of the Contract
Documents is doubtful or obscure, or that the Plans contain
errors or reflect omissions, he should report such opinion
or opinions to the Engineer, at least five (5) days before
the date for the formal opening of bids, in order that
appropriate addenda may be issued by the Engineer, if
necessary, to all prospective Bidders before bids are filed
with the City. The Engineer will not be responsible for

oral Interpretation given either 'iy himself or a member
of his staff, the issuance of a writ -ten addendum being, the
only official method whereby such an interpretation Will
be given.
12. OATH OF ALLEGIANCE: Ordinance No. 4980 requires the
successful Bidder to execute an Oath of Allegiance to the
United States of Ameriea before a Contract can be executed.
13. EQUAL EMPLOYMENT OPPCRTUNITY: Bidders are required to
submit to the City of Miami proof and supporting documenta-
tion in such form and in such manner as the City may require,
evidencing that the bidder does not discriminate against
persons on the basis of race, color, creed, sex, age, or
nationality, in employment, including the upgrading, demotion,

2,01 DEFINITION
The purpose of this division is to provide coverage for
all conditions applicable to this contract, where such coverage
is not provided for in other portions of the Contract Documents,
In case of any conflict with the provisions of other
portions of the Contract Documents, the provisions of this
division will prevail, unless amended in addenda issued
subsequent to publication of these Contract Documents,
2.02 DESCRIPTION OF PLANS
The Plan Sheet, (Misc. 17 NW 1551) for this Project was
prepared by the Department of•Public Works, City of Miami, Florida,
and is bound in this set of Specifications. The Plan is a part
hereof, to the same extent as if herein written in full.
2.03 DESCRIPTION OF THE PROJECT
The Project consists of preparing the concrete and steel
surface of the South Upper Deck of the Orange Bowl in the
designated area as shown on the Plan, Misc. 17 NW 1551 and
applying seal coats to waterproof the overlapped area over the
existing lower press box, comprising approximately 4,050 square
feet.
2.04 LOCATION
The Prc.ject Site is located w.thin the City of Miami's
Orange Bowl Stadium. Address: 1400 N. W. 4 Street, Miami,
Florida.

2,09 SUPERVISION
It is not the City's intention nor responsibility to
coordinate the many activities of the Contractor necessary to
complete a project, The City's responsibility is to see that
the Project is carried on in conformance with the Plans and
Specifications. In many of our past jobs we have experienced
difficulty because of a lack of adequate superintendents. See
Section 6-6 in Division 1- General Conditions,
THE CONTRACTOR IS HEREBY ALERTED AS PART OF THESE CONTRACT
DOCUMENTS THAT A COMPETENT SUPERINTENDENT SHALL BE IN RESPONSIBLE
CHARGE ON THE JOB AT ALL TIMES.

When dry' a fiberglas membrane shall be placed and brush
coated on all protruding edges and corners, (inside and outside).
All vertical voids shall be patched and sealed and allowed to
dry for twenty-four (24) hours. Use Chem -"East 2816 for this
operation.
Upon completion of the above, an application of
Chem-Elast 2819R (or equal); shall be placed and :chile still
wet, medium grade granules (white) , as supplied by Fry
Manufacturing Company, shall be applied and spread evenly
throughout the wetted and tacky horizontal surfaces only and
tamped and compacted to insure adhesion and a smooth surface.
Caution shall be used to prevent granules. adhering to vertical
surfaces. This application must be allowe .• a minimum of
sixteen (16) f.3lip s to dry and set, After this period the
surface shall be :wept clean and the seat benches shall be
installed in their proper order.
