HomeMy WebLinkAboutR-78-0469RESOLUTION No ► i 8" 4 6 9 A RESOLUTION FINDING AND DETERMINING THE PUBLIC NEED AND NECESSITY FOR ACQUIRING THE FEE SIMPLE TITLE TO CERTAIN PROPERTY DESCRIBED HEREIN TO BE USED FOR PUBLIC PARK AND RECREATIONAL PURPOSES FOR THE COCONUT GROVE MINI -PARK AND, DIRECTING THE CITY LAW DEPARTMENT TO INSTITUTE AND PROSECUTE TO A CONCLUSION ALL OF THE NECESSARY LEGAL ACTIONS TO ACQUIRE THE FEE SIMPLE TITLE TO THIS PROPERTY AS SOON AS• IT I5 LEGALLY POSSIBLE, INCLUDING THE FILING OF A DECLARATION OF TAKING. WHEREAS, the City of Miami is empowered by its Charter to acquire in fee simple by condemnation or otherwise property real or personal, or any estate or interest therein, for any of the purposes of the City; and WHEREAS, the City Commission finds that the acquisition of the fee simple title in and to property described in Section 1 is necessary for public park and recreational purposes for the Coconut Grove Mini -Park; and WHEREAS, the City Property Manager has been unable to reach a purchase agreement for subject property; and WHEREAS, the City Commission finds that as soon as the sub- ject property is acquired the City will be ready to begin construction of the Coconut Grove Mimi -Park; and WHEREAS, it is necessary that appropriate steps to acquire the property described in Section 1 be taken so that said property may be made ready to accommodate the public need for the additional park facility; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: "DOCUMENT, INDEX dT Lb�,-: - Section 1. It is herebydetermined and foun e � a public purpose in order to provide for park facilities for the Coconut Grove Mini -Park that the following property be acquired in fee simple by gift, purchase, or condemnation, to wit: West 1/2 of Lot 21 and all of Lot 22, Block 28 FROW HOMESTEAD SUBDIVISION, as recorded in Plat Book "B" at Page 106 of the Public Records of Dade County, Florida. CITY COMMISSION METING OF JUL1 3 1978 RESOLUTION NO REMARKS: Section 2. That the City of Miathi. Florida, its agents and employees are hereby directed to acquire by gift, purchase or condemnation, the fee simple title in and to the property described in Section 1 above as soon as it is legally possible, including the filing of a declaration of taking and utilization of any and all statutes of the State of Florida applicable thereto. Section 3. The City of Miami, its employees and agents are authorized and directed to incur all the necessary expenses to institute and maintain said condemnation proceedings. 1978. Gunderson Director of Finance June 21, 1978 Coconut Grove Mini=park Condefination Proceedings By memorandum dated July 26, 1977, Dena Spillman, Administrator of Community Development, authorized the appraisals and purchase of property located at the corner of Elizabeth Street and Grand Avenue in Coconut Grove to be used for a mini -park. Appraisals were solicited from nineteen MAI appraisers, with seven responses. The two appraisals selected were the lowest of all proposals received. The property was appraised at $11,250.00, and this offer was tendered to the attorney of the owners, Martin Fried, Esq., along with a bonus of $1,062.50, making the total offer $12,312.50. Subsequently, the offer was refused by the attorney for the owners and all further negotiations failed. Therefore, it is recommended that this property be acquired by condemnation for use of the Coconut Grove citizens as a mini -park. Community Development concurs with this recommendation to condemn.
