HomeMy WebLinkAboutO-08836AMatyiENT Rol 26 _TO oRb1NANCE Rd, On biNANCE No, 3 6 b AN EMERGENCY ORbINANCE AMENDING SECTION 1 OF ORbINANCE NO, 8731, ADOPTED bECEMEER 16, 1977, AS AMENDEb, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENbING SEPTEMBER 30, 19781 BY INCREASING THE APPROPRIA- TION FOR THE GENERAL FUND, DEPARTMENT OF LEISOPE SERVICES, IN AN AMOUNT or $46,000; DECREASING THE APPROPRIATION FOR THt GENERAL ?UNb, SoLIb WASTE DEPARTMENT, IN THE SAME AMOUNT; FOR THE PURPOSE OF FUNDING PANTY -FOUR (24) LIFE, - GUARD POSITIONS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE, WHEREAS, the City Commission adopted Ordinance No, 8731 on December 16, 1977 establishing revenues and appropriations for the City of Miami, Florida for the fiscal year ending September 30, 1978; and WHEREAS, the Department of Leisure Services has requested twenty- four (24) temporary Lifeguard positions for an eleven -week period; and WHEREAS, said positions, initially budgeted for fiscal year 1977-78, were eliminated in the modified budget and transferred to CETA funding; WHEREAS, due to the freeze on CETA positions, funds are required in an amount of $46,000 by the Department of Leisure Services for the twenty- four (24) summer Lifeguard positions originally budgeted for CETA in fiscal year 1977-78; and WHEREAS, due to a delay in the opening of a new weigh station in the Solid Waste Department, surplus funds are available and can be appropriated to the Department of Leisure Services for the purpose of funding the twenty-four (24) Lifeguard positions; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further ground of the necessity to make, the required and necessary payments to its employees and officers, payment of its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 5. The ordinances are as follows: (1) An ordinance appropriating $34,882 in revenue for Marine Sta ui to enable this agency to pay expenses incurred during the "Champion Spark Plug Unlimited Regatta" held June 2, 3, and 4, The aforementioned sum represents the revenues collected during this event. (2) An ordinance establishing a Trust and Agency Fund entitled "Police Second Dollar Training", and appropriating $132,650. Of this sum, $82,440 will be appropriated from a projected surplus in Special Programs and Accounts in the General Fund. This action is necessary because in fiscal year 1976-77 excess funds from this dedicated revenue were inadvertently lapsed 88 3 into the General Fund fund balance. The $50,210 balance is "Police Second Dollar Training" revenue to be received from Dade County for fiscal year 1977-78. An ordinance transferring $46,000 from Solid Waste to Leisure Services to cover the cost of Summer Lifeguards. Surplus funds are available in the Solid Waste Department Weigh Station t 88 3 6 appropriation due to the delay in opening of the facility. (4) An ordinance increasing the expense allowance appropriation for the City Commission by $1,800. The City Commission adopted a resolution in December 1977 increasing each Commissioner's expense allowance from $750 annually to $1,200. The cost for this increase is $450 per Commissioner for a total requirement of $1,800. Each summer, for an eleven -week period, our department must supplement the year-round swimming pool staff of one (1) Pool Manager, one (1) Lifeguard and one (1) Cashier per pool, with twenty-four (24) temporary Lifeguards. The three (3) additional Lifeguards per pool not only assist in providing for the general safety of the many youth utilizing the pools in the summer months, but conduct Learn -to -Swim lessons in conjunction with the volun- teer acquactic swim clubs. Funds were initially budgeted in our 1977-78 budget request. However, the modified budted showed that these positions had been eliminated and transferred to the CETA program. Conse- quently, the hiring freeze placed on the CETA progran prevented the City from using this source as a means of funding the twenty- four summer Lifeguards (see attached memorandum dated May 23, 1978 - Funding for 24 Summer Lifeguads.) We also found the CETA requirements to be inappropriate for this particular purpose. All Lifeguards must possess a current Water Safety Instructor's card. We request that the ordinance prepared by the Department of Budget and Management, to increase the General Fund appropria- tions for the Department of Leisure Services in the amount of $46, 000 for summer Lifeguards, be approved.
