AN EMERGENCY ORDINANCE ESTAELISHING A NEW TRUST AND AGENCY FUND ENTITLEb: "POLICE SECOND bOLLAR TRAINING" FOR THE POLICE DEPARTMENT; APPROPRIATING THERETO AN AMOUNT of $132,650; $820440 TO Et APPROPRIATED FROM THE GENERAL FUND, SPECIAL PROGRAMS AND ACCOUNTS, AS A REPAYMENT OF SECOND DOLLAR MONIES INADVERTENTLY LAPSED INTO THE FISCAL YEAR 1976-7'7 GENERAL FUND, ?UNb BALANCE; $50,210 TO BE APPROPRIATED FROM REVENUES ANTI- CIPATED IN FISCAL YEAR 1977-78 FROM BADE COUNTY PURSUANT TO F'LORIhA STATUTES, CHAPTER 943.25(5); AND MAKING APPROPRIATIONS THEREFROM FOR THE PURPOSE OF PROVIDING LAW ENFORCEMENT TRAINING AND EDUCATION; CONTAINING A REPEALER PROVISION AND A SEVERAEILITY CLAUSE. WHEREAS, Florida Statutes, Chapter 943.25(3) authorizes the assessment of one dollar ($1.00) as an additional court cost against every person convicted for violation of a state penal or criminal statute or convicted for violation of a municipal or county ordinance and in addition, $1.00 from every bond estreature or forfeited bail bond related to such penal statutes or penal ordi- nances and for payment for such funds into the state treasury; and WHEREAS, Florida Statutes, Chapter 943.25(5) permits municipalities and counties to assess an additional $1.00 as aforesaid, for law enforcement officers; and WHEREAS, Dade County Resolution No. 103-75 (Section 1.) authorizes the aforesaid assessments to be "earmarked specifically for law enforcement training and educational purposes;" and WHEREAS, Dade County Resolution No. 103-75 (Section 2.) provides for such funds to be credited on a pro-rata basis by the number of authorized sworn officers in duly authorized law enforcement agencies in Dade County at the commencement of each county budget year; and WHEREAS, Dade County Resolution No, 103-75 (Section 3,) resolves that. a mutually agreeable plan for the efficient distribution of such funds among the affected law enforcement agencies be established by the County Manager or his duly authorized representative; and i fE :A, the City of Miami Otdifiahce too: 8613s dated datuarY 2,) 19/ af: afttehdffieht to Ordinance No. 8689 adopted t4ovember ill 1916 ) the annual appropriations ordinance tot fiscal Year 19/6 1s establishes a special accouht ih the Police bepartfreht for tr`aihing fuhded by the $1,00 Additional Assess eht in f'ihes per Florida Statutes Chapter 543,25 (3 and 5)1 an WHEREAS, it is deemed appropriate that a heW Trust and Agency Fund entitled: "Police Second Dollar Training," be established to receive the dedicated revenues as hereih desighated; and WHEREAS, it is estimated that revenues totalling $132,650 will be available to the "Police Second Dollar Training Program" iri fiscal year 1977-781 and WHEREAS, $82,440 of said revenues is appropriated in the General Fund, Special Programs and Accounts, Contingent Fund, and $50,210 will be received from Dade County, amounting to a total appropriation of $132,650 to establish the aforementioned Trust and Agency Fund; NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Trust and Agency Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Police Second Dollar Training RESOURCES: $1.00 additional assessment of court costs per State Statute 943.25 (3. and 5.) APPROPRIATION: $132,650 Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. The ordinances are as follows: (1) An ordinance appropriating $34,882 in revenue for Marine Sta ui to enable this agency to pay expenses incurred during the "Champion Spark Plug Unlimited Regatta" held June 2, 3, and 4, The aforementioned sum represents the revenues collected during this event. (2) An ordinance establishing a Trust and Agency Fund entitled "Police Second Dollar Training", and appropriating $132,650. Of this sum, $82,440 will be appropriated from a projected surplus in Special Programs and Accounts in the General Fund. This action is necessary because in fiscal year 1976-77 excess funds from this dedicated revenue were inadvertently lapsed 88 3 into the General Fund fund balance. The $50,210 balance is "Police Second Dollar Training" revenue to be received from Dade County for fiscal year 1977-78. An ordinance transferring $46,000 from Solid Waste to Leisure Services to cover the cost of Summer Lifeguards. Surplus funds are available in the Solid Waste Department Weigh Station t 88 3 6 appropriation due to the delay in opening of the facility. (4) An ordinance increasing the expense allowance appropriation for the City Commission by $1,800. The City Commission adopted a resolution in December 1977 increasing each Commissioner's expense allowance from $750 annually to $1,200. The cost for this increase is $450 per Commissioner for a total requirement of $1,800. (3) cl 8837
