CONTAINING A REPEALER PROVISION AND A SEVERABILITY
CLAUSE,
WHEREAS, the City Commission adopted Ordinance No. 8731 on December
16, 1977 establishing revenues and appropriations for the City of Miami,
Florida for the fiscal year ending September 30, 1978; and
WHEREAS, the City Commission adopted Resolution No. 78-285, dated
April 27, 1978, authorizing the City Manager to execute an agreement with
Champion Spark Plug Company for the staging of the Eighth Annual Champion Spark
Plug Unlimited Regatta at Miami Marine Stadium on June 2, 3, and 4, 1978; and
WHEREAS, said agreement provides for rental of the Marine Stadium,
race course and buoys, telephone service, rescue and fire equipment and
personnel, stadium crew, tickets, public address system, judges, photo stand,
and janitorial service to be provided at City's expense; and
WHEREAS, expenses for the staging of the Eighth Annual Champion
Spark Plug Unlimited Regatta amount to $34,882; and
WHEREAS, the Internal Audit Division reports total revenues collected
for staging said event, including the City's charge for the rental of Marine
Stadium, amount to $39,382; and
WHEREAS, $4,500 of the aforementioned revenues has already been
appropriated by the Marine Stadium as rental income for staging this event; and
WHEREAS, the balance of revenues collected, namely $34,882, can be
appropriated into the Enterprise Funds, Marine Stadium, for the purpose of
making payment of the aforementioned expenses;

Section 3, Ali ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance ate
hereby repealed,
Section 4, if any section, part of section, paragraph, clause, phrase,
or word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected,
Section 5, This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, and upon the further
ground of the necessity to make the required and necessary payments to its
employees and officers, payment of its contracts, payment of interest and
principal on its debts, necessary and required purchases of goods and
supplies, and to generally carry on the functions and duties of its municipal
affairs.
Section 6. The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote of not less than four -fifths
of the members of the Commission.

Attached please find four ordinances prepared for the July 27, 1978 City
Commission meeting. The ordinances are as follows:
(1)
An ordinance appropriating $34,882 in revenue for Marine Sta ui
to enable this agency to pay expenses incurred during the
"Champion Spark Plug Unlimited Regatta" held June 2, 3, and 4,
The aforementioned sum represents the revenues collected during
this event.
(2) An ordinance establishing a Trust and Agency Fund entitled
"Police Second Dollar Training", and appropriating $132,650.
Of this sum, $82,440 will be appropriated from a projected
surplus in Special Programs and Accounts in the General Fund.
This action is necessary because in fiscal year 1976-77 excess
funds from this dedicated revenue were inadvertently lapsed 88 3
into the General Fund fund balance. The $50,210 balance is
"Police Second Dollar Training" revenue to be received from
Dade County for fiscal year 1977-78.
An ordinance transferring $46,000 from Solid Waste to Leisure
Services to cover the cost of Summer Lifeguards. Surplus funds
are available in the Solid Waste Department Weigh Station t 88 3 6
appropriation due to the delay in opening of the facility.
(4) An ordinance increasing the expense allowance appropriation
for the City Commission by $1,800. The City Commission adopted
a resolution in December 1977 increasing each Commissioner's
expense allowance from $750 annually to $1,200. The cost for
this increase is $450 per Commissioner for a total requirement
of $1,800.
