WHEREAS, the City desires to improve the efficiency and adaptability of the sale of season reserved -parking passes at the Orange Bowl parking lots for both the University of Miami and the National Football League professional football games scheduled at the Orange Bowl; and WHEREAS, the present ordinance setting a flat rate for season parking passes does not take into account that the number of games scheduled to be played at the Orange Bowl by these two major users, may vary from year to year; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Subsection 39-24(a) of the Code of the City of Miami, Florida, is hereby repealed in its entirety and a new Subsection 39-24(a) is hereby substituted therefor, as follows: "Sec. 39-24. Parking Charges. (a) Season passes permitting parking at the Orange Bowl Stadium reserved parking area on the day of any pre -scheduled football event to be played by either the University of Miami or the National Football League (NFL) teams during their respective seasons may be secured by payment of the following; (i) (a) $4.00, including state sales tax,per passenger car, multiplied by the number of pre -scheduled exhibition and regular season NFL professional football events, (b) $5,00, including state sales tax, per recreational. vehicle, multiplied by the number of pre -scheduled exhibition and regular season NFL professional football events, (WO) $4100, ittcluditig state sales tak, pet passenger car, multiplied by the number of preffischeduted University of Miami football extents. (b) $5.00, including state sales tax, per recreate tional vehicle, multiplied by the number of pre -scheduled University of Miami football eVents. (iii) The above season parking passes entitle bearers to a reserved parking space for intra=naquad scritnmages held at the Orange Bot 1 by either the University of Matta football teats ot the NVL team at no additional cost." Section 2. All ordinances, ot parts of ordinances, itt conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. "CLosuflCs: Copy of draft Ordinance The present Ordinance No. 8648 governing Orange Bowl parking establishes a flat rate for passenger car and recreational vehicle "season" parking for all pre - scheduled U.M. and Miami Dolphins football games respectively. These rates were developed by multiplying $4.00 for passenger cars and $5.00 for recreational vehicles, times the number of games that have traditionally been held at the Orange Bowl. The University of Miami, however, has only four (4) scheduled games to be played at the Bowl during the 1978 "season", rather than the six (6) games played last year. Assuming that the number of games scheduled to be played at the Orange Bowl by the University of Miami and the Dolphins may vary from year to year, it is proposed that the flat rate seasonal fees be repealed, and in their place, the formula of $4.00 per passenger car and $5.00 per recrea- tional vehicle multiplied by the number of games scheduled to be played in a particular year, be implemented. The Department of Stadiums and Marinas recommends the adoption of the enclosed Ordinance further amending Sec. 39-24 of the Code as amended.
