HomeMy WebLinkAboutR-78-0495RFC/rb 7/ 17. 78 "SUPPORTIVE DOCUMENTS FOLLOW" RESOLUTION NO 78"495 A RESOLUTION CALLING AND PROVIDING FOR A SPECIAL MUNICIPAL ELECTION TO BE HELD ON THE 5TH DAY OF OCTOBER, 1978, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF MIAMI FOR THEIR APPROVAL OR DISAPPROVAL A MEASURE KNOWN AS ORDINANCE NO. 8819, PASSED AND ADOPTED BY THE CITY COMMISSION ON JUNE 22, 1978, GRANTING TO THE SOUTHERN BELL TELEPHONE AND TELEGRAPH COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE GRANTING THE RIGHT TO THE USE OF PUBLIC RIGHT OF WAY TO INSTALL NECESSARY TELEPHONE EQUIPMENT; PROVIDING FOR ONE PERCENT FRANCHISE FEE, INCREASING BY ONE PERCENT IN EACH OF TWO SUCCEEDING YEARS AT THE SAME TIME AND RATE THE FEDERAL EXCISE TAX IS SCHEDULED TO BE REDUCED; PROVIDING FOR ALL PAYMENTS IN EXCESS OF ONE PERCENT TO BE DEPOSITED IN A TELEPHONE FRANCHISE PUBLIC CONSTRUCTION RESERVE ACCOUNT, IMPOSING PROVISIONS AND CONDITIONS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission, at a regular meeting, duly called and held according to law, on the 22nd day of June, 1978, duly passed and adopted a measure known as Ordinance No. 8819, granting a franchise for the use of its streets to Southern Bell Telephone and Telegraph Company; and "DOCUMENT ENEX WHEREAS, said Ordinance shall beciomk`lmy in the event that it shall be approved by a majority of the qaulified electors of the City of Miami voting at a special municipal election held for the purpose of enabling said electors to register their approval or disapproval of said Ordinance; and WHEREAS, it is appropriate and necessary that the City Commission make provision for holding said special municipal election; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. Said special municipal election shall be held at the voting places in the precincts designated, all as shown on the list attached hereto and made a part hereof and referred to as Exhibit No. 1. Section 6. The City Clerk shall cause to be pre- pared absentee ballots containing the Question set forth in Section 4 above for the use of absent electors entitled to cast such ballots in said election. Section 7. All qualified electors of the City shall be permitted to vote in said special municipal election and the Super- visor of Elections of Dade County is hereby requested, authorized and directed to furnish, at the cost and expense of the City of Miami, a list of all qualified electors in the City of Miami as shown by the registration books and records of his or her office and duly to certify the same for delivery to and use of the election officers designated to serve at the respective polling places in said election precincts. Section 8. RALPH G. ONGIE, the City Clerk of the City of Miami, Florida, is hereby designated and appointed as the official representative of the City Commission in all transactions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registration books and the holding of said special municipal election. Section 9. This election is the last action needed to make this franchise agreement effective.
