HomeMy WebLinkAboutR-78-0547"SUPPORTIVE D O C t.J MGM E NT3 FOLLOW" RESOLUTION NO, 7 8 5 4 RESOLUTION ABOLISHING THE CITY OF MIAMI+5 hARTER REVIEW BOARD, WHICH WAS ESTABLISHED ESQ RESOLUTION 38699, MAY 24, 1967, AND CREA- TING A CHARTER ADVISORY COMMITTEE, COMPOSED OF SEVEN (7) MEMBERS, REPRESENTING THE CITY'S LEGAL STAFF, THE CITY'S ADMINISTRATION, AND THE GENERAL PUBLIC, FOR TIIE PURPOSE OF INVES- TIGATING HOW THE CITY CHARTER. CAN BE MODERN- IZED AND MODIFIED TO PROVIDE FOR MORE EFFICIENT AND MORE RESPONSIVE ADMINISTRATION OF THE CITY OF MIAIMI' S AFFAIRS. WHEREAS, the Charter originally was proposed, adopted and confirmed in 1921 and was amended and re-enacted by the Florida State Legislature in 1925, with several changes and amendments adopted thereafter; and WHEREAS, the Charter needs periodic review and assess- ment to determine whether the interests of the citizens of Miami continue to be well served by the current provisions f the Charter; and WHEREAS, citizens and the Legislature have seen fit to review and approve changes in the Charter since its original enactment in order to serve the changing needs of the community; NOW, THEREFORE, BE IT RESOLVED BY TIIE COIIMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Charter Advisory Comni7 te'er created and the existing Charter Review Boardlabolished. Section 2. The Charter Advisory Committee shall function in an advisory capacity to the City Commission and shall make recommendations concerning proposed Charter changes at least 2/ once a year no later than June 1 of each year. Section 3. The Charter Advisory Committee will expire on September 1, 1980, at the same time all committee members' terms of office shall end. Section 4. All committee members shall serve without 8Ompensation, although the City Manager may designate an ap- propriate sum to be allocated for supplies, postage, and other costs that might be incurred by the committee in the conduct of its business. Section 6. All meeting times and places shall be communi- cated to the City Clerk at least 10 days in advance of each meeting, and all meetings shall be open to the public. Section 7. Gtassie, City Manager / Robert Ce roman • August 28, 1918 Chattet AdVisoty Coininittee Responding to your request to prepare a legislative proposal to activate aii advisory body to assist in the formulation of changes to the City Charter, I have drafted the attached resolution. This resolution abolishes the existing Charter Review Board, which has been inactive for several years. It establishes an advisory committee with a life of two years. A seven -member committee, as suggested, will bring together advice and knowlege from within the City organization as well as from the community. Representation from the Chamber of Commerce and from the Dade County Bar Association will ensure needed input from the non -city legal profession and from the business community. The City will be represented by the City Attorney and by your designee from the Administration. In addition to the Bar Association and Chamber of Commerce representatives, the City Commission will select three additional persons from the community at large to assist in this task. No residency requirements are called for in the selection of committee members, since the Commission may not want to limit its choices. On the other hand, should the Commission decide to limit candidates to Miami residents only, that can be accomplished through a change in the resolution or by appointing only city residents, since no terms are established for committee members, who will probably serve until the expiration of the committee itself. A June 1 deadline for submission to the City Commission of Charter change proposals will give the committee two opportunities to complete its task. This deadline will also give the Commission and Administration time to analyze and discuss the proposals and still have time to place them on an Autumn ballot. The Advisory Committee's meetings will, of course, be open to the public, and suggestions for consideration can originate from anyone. DOCLI M rNTS FOLLOW"
