A RESOLUTION GRANTING AN EXTENSION OF RESOLUTION
NO. ZB 61-78 AS AMENDED BY RESOLUTION NO. ZB 104-
78, GRANTING A ONE YEAR EXTENSION OF THE VARIANCE
AS LISTED IN ORDINANCE NO. 6871, ARTICLE X,
SECTIONS 5 AND 6, TO PERMIT CONSTRUCTION OF A
PROPOSED RESIDENTIAL DEVELOPMENT FOR THE ELDERLY
(THE BAYSHORE CARLYLE HOUSING FOR THE ELDERLY),
ON LOTS 1 AND 4, BLOCK 7, MIRAMAR 3RD AMENDED (5-4),
BEING 1866 NORTH BAYSHORE DRIVE, AS PER PLANS,
BUILDING AND SITE DATA IN FILE, WITH 2.1 FLOOR AREA
RATIO (F.A.R.) (2.0 PERMITTED) AND 21.16% LOT
COVERAGE (19% PERMITTED), SUBJECT TO PUBLIC AREA WITHIN
BUILDING BEING OPEN DURING NORMAL HOURS; ZONED R-5

WHEREAS, Article XXXI of the Comprehensive Zoning Ordinance
No. 6871, permits an extension of a Variance by the City Manager with
approval by the City Commission for a period of one year; and
WHEREAS, the City Manager recommends a one year extension
of the Variance as granted by Zoning Board Resolution No. ZB 61-78
as amended by Zoning Board Resolution No. ZB 104-78;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI , FLORIDA:
Section 1. The Resolution granting an extension of
Resolution No. ZB 61-78 as amended by Resolution No. ZB 104-78,
granting a one year extension of the variance as listed in Ordinance
No. 6871, Article X, Sections 5 and 6, to permit construction of a
proposed residential development for the elderly (The Bayshore Carlyle
Housing for the Elderly), on Lots 1 and 4, Block 7, MIRAMAR 3RD AMENDED
(5-4), being 1866 North Bayshore Drive, as per plans, building and site
data in file, with 2.1 floor area ratio (F.A.R.) (2.0 Permitted) and
21.16% lot coverage (19% Permitted), subject to public area within
building being open during normal hours; zoned R-5 (High Density Multiple
"DOCUtil"T !!!OE.X

ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871
provides that any Variance shall expire six months after the
effective date of the Variance unless a Building Permit or a
Certificate of Use has been issued based upon the Variance.
The Ordinance further provides that the City Manager may, after
review and determination that substantial progress has been
achieved by the applicant in terms of project planning, extend
the expiration date of the Variance far an additional period of
time not to exceed one year, subject to approval of the City
Commission.
This Department finds no objection to the granting of the
extension of time for this Variance.
We are requesting the City Attorney's office, by copy of this
memo, to prepare the proper Resolution for this extension.

Please consider this letter as a request for the extension of the
variance granted by the Zoning Board on March 20, 1978, as per the
enclosed Notice.
It is my understanding that this variance expires on September 20,
1978. It is also my understanding that the City Commission will
not meet during the month of August. I am sending this letter to
you in order that the hearing might be scheduled whenever you feel
it is appropriate, or at the very latest at the first meeting in
September.
I am leaving next week for a vacation and will be back on August 14th.
In the interim, if there is any matter which you or Mr. Davis would
like to review in connection with this matter, please call my partner,
Bernard Jacobson, who is very familiar with this project.
I am pleased to advise that final plans and specifications have been
completed. The same have been submitted to the City of Miami Build-
ing Department for review and comments. It is anticipated that
construction will commence on this project during the last quarter of
this year.
