WHEREAS, a review of Sections 39-6 and 39--7 of the Code of the City of Miami, Florida, pertaining to procedures and rental rates at Municipal Auditorium and Dinner Key Recreation Center/Exhibition Hall has been undertaken; and WHEREAS, it has been determined that it is in the best interest of the City of Miami that said Sections 39-6 and 39-7 as they exist, be repealed; and WHEREAS, a new Section 39-6 has been prepared and drafted; and WHEREAS, it is the desire of the City of Miami city Commission to implement the provisions contained within the new Section 39-6; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. Sections 39-6 and 39-7 of the Code of the City of Miami, Florida, as amended, are hereby repealed in their entirety and a new Section 39-6 of said Code is hereby enacted, reading as follows; "Sec. 39-6 Changes and Procedures for use of Municipal Auditorium and Danner Key Recreation Center/Exhibition Hall, CITY COMMISSION MEETING OF QkMA1}Ct 1st READttrG...,..... nos..m. 9nd RtAMMO Rental gates include normal janitorial sarviee, shewtime air conditioning, normal house fights and such ether items of available equipment lent as may be necessary for the presentation of at event. Rental rates do not include event personnel or support services including, policemen, firemen, security guards, ushering staff, ticket sellers and ticket takers, stagehands, spotlight operators, musicians, projectionists, booth equipment and installing and dismantling electrical installations. Rental rates are applicable to a day or fraction thereof. Lessee must pay to Lessor as rent for use of premises fifty (50%) percent thirty (30) days prior to occupancy of premises. All advance rental deposits will be forfeited if Lessee cancels event. (a) MUNICIPAL AUDITORIUM RENTAL SCHEDULE: 1. Trade shows, exhibitions, consumer shows: a. caribbean Room $500, per day flat b. If any section, sentence, clause, phrase or word of this ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding or invalidity shall be construed to have been the intent of the Commission of the City of Miami to pass this ordinance without such unconsti- tutional, invalid, or inoperative part therein; and the remainder of this ordinance, after the Exclusion of such part or parts shall be deemed and held to be valid as if such parts had not been included therein. We surveyed twelve auditoriums and exhibition halls of comparable size and usage in the industry nationwide. Our rates compare favorably with those of similar facilities. Our suggested rates will be competitive on a local level. Sections 39-6 and 39-7 of the code of the City of Miami, Florida, as amended, relating to the charges for use of Dinner Key Recreation Center/Exhibition Hall have been reviewed by this department. It has been determined that the fees and procedures established in 1971 are no longer realistic. In the case of Dinner Key Recreation Center/Exhibition Hall, the fees were reduced by City Commission action in March 1975 due to the fact the building had deteriorated to the point that it had become difficult to rent. Since the renovation project is expected to be completed by 1978 it is necessary that we set a schedule of fees at this time. The Department of Stadiums and Marinas recommends the adoption of a section of the ordinance, repealing section 39-6 and 39-7 of the code in its entirety, and enacting a new section 39-6, establishing new rental rates and procedures.
