HomeMy WebLinkAboutR-78-0582RESOLtJTION No: Tft. 5 8 2 RESOLUTION ACCEPTING THE BID OF ANDY FAIN OF FLORIDA, INC, FOR FURNISHING SECURITY PERSONNEL FOR THE ORANGE BOWL, As REQUIRED, ON A GAME TO GAME BASIS; AND AUTHORIZING THE CITY MANAGER TO ENTER INTO THE ATTACHED AGREEMENT BETWEEN THE CITY OF MIAMI AND ANDY FRAIN OF FLORIDA, INC. FOR PROVIDING SAID SERVICE IN ACCORDANCE WITH THE TERMS OF THE BID, WITH FUNDS ALLOCATED FROM CONTRACTUAL SERVICES FOR ORANGE BOWL TO COVER THE COST. WHEREAS, the City desires to enter into an Agreetent With a private security firm for furnishing security personnel for Orange Bowl events on a game to -Fame -basis, and; WHEREAS, the Department of Stadiums and Marinas received bids from three firms for providing this service, and; WHEREAS, it was determined that the bid of Andy Frain of Florida, Inc. was the most advantageous to the City, and; WHEREAS, time is of the essence, and; WHEREAS, the Department of Stadiums and Marinas recommends the execution of an Agreement between the City and Andy Frain of Florida, Inc. for furnishing security personnel as required for Orange Bowl events. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The bid of Andy Frain of Florida, Inc. for furnishing the Department of Stadiums and Marinas with security personnel, as required, for events as the Orange Bowl, on a game to game basis, is hereby accepted based on the price of $7.50 per hour for Security Supervisors and Officers, with funds hereby allocated from Contractual Services for Orange Bowl Events. Section 2. The City Manager is hereby authorized to execute the attached contract between the City of Miami and Andy Frain of Florida, Inc. PASSED AND ADOPTED THIS 15TH DAY OF SEPTEMUR 1978. It is now in order for the City Commission to authorize the City Manager to accept the bid of Andy Frain of Florida, Inc. and to execute an agreement with said firm for furnishing security personnel at Orange Bowl events, as requested, on a game to game basis. The Department of :stadiums and Marinas recommends adoption of the attached Resolution. cc City Attorney to 78 582 ( EINIEINIEr MMIk MEEK ME ■ME ■ ■ this Agreement entered into this day 1978, by and between THE CITY OF MIAMI, a municipal corporation f the State of Florida, hereinafter referred to as "the City", and ANDY FRAIN OF FLORIDA, INC., hereinafter referred to as "Andy Frain". WITt'IESSETH WHEREAS, the City desires to enter into an Agreement With a private security firm for furnishing security personnel- for Orange Bowl events on a game to game basis, and; WHEREAS, the Department of Stadiums and Marinas received. from three firms for providing this service, and; WHEREAS, it was determined that the bid of Andy Frain was the most advantageous to the City, and; WHEREAS, time is of the essence, and; WHEREAS, the City Commission is not in session dur month of August, and; WHEREAS, the Department of Stadiums and Marinas recommends the Andy Frain for execution of an Agreement between the City and furnishing security personnel for Orange Bowl events, subject to ratification by the City Commission at a later date. NOW, THEREFORE, in consideration of the covenants and affirmations as herein set forth, the parties agree as follows; The term shall be on a game to game basis commencing upon execution of this Agreement. III.SERVICES PROVIDED. A. Andy Frain agrees to provide security personnel for Orange Bowl events under the terms and conditions hereinafter described. B. For the specified consideration rate, Andy Frain agrees to provide up to sixty (60) security employees, including super- visory personnel, during professional events and as many as seventy-five (75) for other special events, such as the Orange Bowl Classic and the Super Bowl Game. C. The numbers of security personnel, and supervisory per- sonnel, to be provided by Andy Frain for each event shall be as determined by the Stadium Manager, and as specified by him to Andy Frain at least 10 days prior to the event date. IV. ANDY FRAIN COVENANTS AND AGREES: A. That all personnel furnished under the terms of this Agreement shall be eighteen (18) years of age or older, and shall be well-groomed, neat, clean, and courteous at all times. B. That all personnel furnished under the terms of this Agreement shall be furnished uniforms by Andy Frain, including proper identification, and that guns will not be a part of the prescribed uniform. The type of uniform shall be as approved by the City Manager, or his authorized representative. C. That all personnel furnished under the terms of this Agreement shall report for work two hours before game time and remain until all patrons have left the premises. F. To have supervisory personnel available for any and all Manning discussions which may be reasonably required prior to any event, at Andy Frain expense. G. To have senior personnel assigned to each event regularly. meet with the City of Miami Police Department's Commander on duty coordinate event security activities. H. To provide all equipment necessary for communication_ throughout the Orange Bowl Stadium at Andy Frain expense; and to provide capability to communicate with the City of Miami police on site, if required. I. To obtain City of Miami licenses prior to the execution f this Agreement, and to comply with all City, and Federal rules, regulations, and laws now in force or hereafter adopted. J. That all personnel furnished under the terms of this Agreement shall be covered by Workmen's Compensation; Unemployment Compensation; and liability insurance as approved by the City Insurance Manager and copy of which is provided to the City Insurance Manager for file. The public liability insurance policy shall be in the amount of $1,000,000 per occurrence. K. That services to be performed by Andy Frain under the terms and conditions of this Agreement must be performed and maintained to standards established by the City. L. Not to, at any time during the term of this Agreement) ublet or assign any portion or part of the Agreement, except upon written permission of the City Manager. 0. To indemnify and save harmless the City against any and all claims, suits, actions, damages or causes of action arising during the term of this Agreement, for any personal injury, loss of life, or damage to property sustained in or on City property by reason of Andy Frain or Andy Frain employee occupancy, use, activities, and operations thereon except if caused by or occurring as a result of the negligence of the City, its employees, its agents, or its representatives; and from and against all costs, attcrney's fees, expenses, and liabilities incurred in the defense of any such claim or investigation thereof. P. That there shall be no discrimination as to race, color, creed, or national origin in connection with the performance of its responsibilities under this Agreement. Q. That Andy Frain shall not commence work under this contract until it has obtained public liability insurance of $1,000,000.00 per occurrence for bodily injury. Andy Frain shall maintain such required insurance in force during the life of this contract. No modification or change in insurance shall be made without thirty (3C) days advance written notice to the City through its Property or Insurance Manager. The policy and the insurance carrier must be acceptable to the City Insurance Manager and a copy of the insurance policy shall be filed with the City Clerk of the City before this contract is approved, R. To make payments to Andy Frain in accordance with the Specified consideration rate, within thirty (30) days after receipt of an invoice and properly executed listing of personnel utilized at an event. B. To pay Andy Frain, in full, if an event is cancelled for any reason after the gates to the stadium have been opened. If the staff or Andy Frain reports to work and the event is cancelled prier to the time that the gates are opened, Andy Frain shall be compensated at a rate of $2.50 per employee. C. To provide a maximum of ten (10) parking spaces for the special use of Andy Frain personnel assigned to work an event. VI. BIB?DING ON SUCCESSORS: This Agreement shall be binding upon the City and Andy. Frain, their successors and assigns, and they shall abide by each of the terms and conditions thereof.
