A RESOLUTION AMENDING RESOLUTION NO. 73-537 ADOPTED
JULY 12, 1973, ENTITLED "A RESOLUTION GRANTING A
'CONDITIONAL USE' , AS PROVIDED IN ORDINANCE NO. 6871
ARTICLE XV, SECTION 2(8)(a), TO PERMIT CONSTRUCTION

WHEREAS, the City Planning and Zoning Board of the City of
Miami at its meeting held on June 11, 1973, passed and adopted by an
8 to 0 vote its Resolution No. 73-133, recommending granting a
"conditional use" as provided in Ordinance No. 6871, Article XV,
Section 2(8)(a), as hereinafter set forth; and
WHEREAS, this Commission deems it advisable to the public
convenience and welfare to release Lot 8 of Prouts Subdivision (B-65)
from the restriction that said lot be developed only as surface
parking;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That Section 1 of Resolution No. 73-537 adopted
July 12, 1973, entitled "A resolution granting a 'conditional use'
as provided in Ordinance No. 6871, Article XV, Section 2(8)(a), to
permit construction of 7-Level parking garage on Lots 4, 5, 16, 17 and
E 1/2 Lots 6 and 15 Block 103N, Miami (B-41), located at approximately
245 N.E. 1st Street, subject to Lot 8 of Prouts Subdivision (B-65),
to be developed only as surface parking; zoned C-3 (Central Commercial)
District", be and is hereby amended by the deletion of the following
language therefrom: Subject to Lot 8 of PROUTS SUBDIVISION (B-65),
to be developed only as surface parking.

ANALYSIS
In the ensueiny five years since the original stipulation on Lot 8
was made, there has been renewed investment in the area at fected by the
proposed re -alignment. The former bus terminal has been remodeled,
several buildings have been remodeled .as Galleries international and the
YMCA is initiating a fund-raising campaign to construct a new building.
Substantial future development is foreseen in the block now occupied
by the McAllister and Columbus Hotels.
Realignment of E 3rd Avenue would impluve downtown trattic circulation
by:
1. Providing the potential for a one-way pair using E 2nd
Avenue for southbound traffic and E 3rd Avenue for northbound
traffic.
2. Providing for traffic circulati,n on the east side of the
CBD without being forced out onto Biscayne Boulevard.
3. Facilitating M,A bus operations.
Through the authority delegated to the Director of the Public Works
Department (City Code, Section 2-82.1) for establishing minimum stan-
dards for streets, the City, since 1958, has mapped several future
streets. This procedure might be followed in the present case.
ALTERNATIVE
The potential for the future realignment of E 3rd Avenue could be
addressed through either of two procedures:
1. Alternate "A" (attached) - Map a new alignment extending
directly north from the intersection of Flayle:r Street/SE
3rd Avenue to NE 2nd Street in which instance the subject
lot 8 would continue to have development restrictions.
With the substantial development furseen in the area, part
of the alignment might be secured by trading air -rights over
the former NE 3rd Avenue, which ought be developed as a
pedestrian mall. 'r

RECOMMENDATION
It is recommended that the applicants' request be approved by lifting
the development restrictions on the subject Lot 8. E'urthei- it is
recommended that the Commission direct the administration to initiate
hearings before the Zoning Board in mapping a future curved re -alignment
of E 3rd Avenue from Flagler Street/SE 3rd Ave to NE 3rd Avenue/NE
1st Street (Alternate B).

Dear Mr. pavis:
As you may recall, during the past three years we have discussed
several occasions the need for First Federal to be granted release from
a condition imposed upon Lot 8, as described in the second paragraph of
the attached letter.
Development in the immediate area upon northeast Third Avenue would
indicate that City Commission Resolution 7b-blb (Downtown People Mover
routing) is doubtful to ever take place at this time. In order that
this Association may he free to negotiate a disposition of this property,
would you please arrange for our representative to appear al the next
zoning meeting of the City Commission on September 28th, in an effort
to seek a release of said property.
Once again, we thank'you and Mr. Joseph McManus for your assistance in
this matter.

On February 17, 1978 representatives of the: 1)ade. County Office of 'Transa
portation Administration, the Dade County Department 'Traffic and Transport:
tation, the City of Miami Public Works Department, Planning Department.
and the Downtown Development Authority met to evaluate e urrent policy
regarding proposals for E. 3rd Avenue. 'ibis is an alternative alignment. for
the Downtown People eNtover which has received approval for preliminary
engineering in the amount of $1. 3 million by the federal urban Mass '1 rans-
portation Administration. It is expected that within the next six months a
determination will be made of the alignment for the I)o.vntown People ,Mover.
Further, the agencies represented that there is continued merit in considering
transportation improvements on .3rd Avenue for surface traffic movements
and that further investigation should be made of the various ways of accompli-
shing this. ,
In my conversation with you of February 2.1, I indicated this general time frame
to you and you responded that you would again raise the question in approximately
six months. I hope this letter serves to clarify the situation retarding the
property in question.

A RISOLU ION GRANTING A "CONDITIONAL
WEN, AS PROVIDED IN ORDINANCE NO. 6871,
ARTICLE XV, SECTION 2 (8) (a) , TO PERMIT
CONSTRUCTION OF 7-LEVEL PARKING GARAGE
ON LOTS 4, 5, 16, 17 AND E 1/2 LOTS 6
AND It/ BLOCK 103N, MIAMI ( -41) , LOCATED
_ AT APPROXIMATELY 245 N. E. 1ST STREET;
SUBJECT TO LOT 8 OF PROUTS SUBDIVISION
(B-65), TO BE DEVELOPED ONLY AS SURFACE
PARKING; ZONED C-3 (CENTRAL COMMERCIAL)
DISTRICT.
WHEREAS, the City Planning and Zoning Board
of the City of Miami, at its meeting held on June 11, 1973,
passed and adopted by an 8 to 0 vote its Resolution No.
73-133, recommending granting a "conditional use" as provided
in Ordinance No. 6871, Article XV, Section 2(8)(a), as
hereinafter set forth; and this Commission deems it advisable
to the public convenience and welfare and finds that the
use will not be detrimental or Injurious to the character
or the development of the immediate “eighborhood;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a"conditional
use" as provided in Ordinance No. 6871, Article XV, Section
2(8)(a), to permit construction of 7-level parking garage
on Lots 4, 5, 16, 17, and E 1/2 Lots 6 and 15, Block 103N,
MIAMI (B-41), located at approximately 245 N. E. 1st Street;
subject to Lot 8 of PROUTS SUBDIVISION (B-65), to be developed
only as surface parking; zoned C-3 (Central Commercial)
District, be and the same is hereby granted.
Section 2. This conditional use shall become
null and void unless the use is commenced within six months
of the effective date of this Resolution. Upon application,

tie City Manager may, after review and determination that
aubgtantial progress has been achieved by the applicant
in terms of project planning, extend the expiration date
of the conditional use for an additional period of time
not to exceed one (1) year. Said extension request shall
be filed with the City Manager two (2) weeks prior to the
expiration date of the initial six (6) months effective
period, of the conditional use.
