HomeMy WebLinkAboutO-08853LCD/ab 9.21a/8 AMENDMEN I NO,, ,. ,.,T0 IiR iNANCE NO. 8/31 ORDINANCE NO, 8853 AN EMERGENCY ORDINANCE AMENDING SECTIONS 1 AND 5 OF ORDINANCE NO, 8731, ADOPTED DECEMBER 16, 1977, AS AMENDED, IHL ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 19/8; BY INCREASING THE GENERAL FUND, PENSION, IN THE AMOUNT OF $60,510; AND BY INCREASING ANTICIPATED REVENUES, IN THE SAME AMOUNT FROM 1HE STREET LIGHTING FUND; FUR (HE PURPOSE OF INCREASING RETIREE BENEFITS; CONTAINING A REPEALER PROVISION AND A SEVERAt3ILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 8731 on December 16, 1977 establishing revenues and appropriations for the City of Miami, Florida for the fiscal year ending September 30, 1978; and WHEREAS, the City Commission adopted a motion of intent to grant Pensioners increased pension payments and directed the City Manager to identify funds to pay for same; and WHEREAS, it has been determined that the cost of funding an increase in retiree benefits for the last three months of fiscal year 1977-78 will amount to $60,510; and WHEREAS, this total is based on an 0.5% increase for each full year since retirement with the percentage limited to the first $300 of monthly benefit; and WHEREAS, fiends are available from prior yearsbalances in the Street Lighting Fund and an amount of $60,510 can be appropriated to the General Fund, Pension, for the aforementioned increases; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 8731, adopted December 16, 1977, as amended, is hereby further amended as follows:1/ "Section 1. The following appropriations are made for municipal operations of the City of Miami, Florida for the fiscal year 1977-78, including the payment of principal and interest on all General Obligation Bonds. All figures are rounded to the next dollar. Reflects appropriation increase of $60,510 from anticipated increase of street lighting revenues for current funding of retiree benefits. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section b. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Gary, Director Department of Management & Buaget September 21, 1978 Proposed Legislation fof September 28, 1978, Commission Agenda On September 14, 1978, the City Commission adopted Motion 78-541 to grant pensioners increased benefits and directed the City Manager to identify funds for this purpose. It has been deter- mined that the cost of funding this increase for the last three months of fiscal year 1977-78 will amount to $60,510. FLORIDA INtER•OFFICE MEMORANDUM b*tE: August 23, 1978 FILE SUbJEcV: Increased Benefits to Retirees HEkERENCEsc ENCLOSURCS: The City Commission has been discussing the granting of increased benefits to City of Miami retired employees. Specifically these benefits include 1) increasing retiree pension payments by 1/2% on the first $300 of benefit's times the number of years retired, and 2) increasing retirees pension payments to compensate for the loss of City contribution to retirees' group insurance. Thy costs to provide the first benefit are approximately $42,750 for three months of fiscal year 1977-78 and approximately $171,000 for fiscal year 108-79. The total cost for both fiscal years is $213,750. ram. The second.benefit would cost approximately $17,760 for three months of the fiscal year 1977-78 and $69,840 for fiscal year 1978-79. The total cost for both fiscal years is $87,600. However, it should be noted that the Law Department has rendered a legal opinion prohibiting the City from paying group insurance costs for retirees. Providing additional payments to assist retirees in paying for their group insurance might be considered a circumvention of the state statute by the City's auditors. The cost to grant both benefits in fiscal years 77-78 and 78-79 is $301,350. No provisions hav; been made in either budget for these benefits. As you are aware, departments have had to reduce their fiscal year 1978-79 budgets considerably to stay within projected revenues. �_. r
