AN EMERGENCY ORDINANCE AMENtING SECTIONS 1 AND 5 OF
ORDINANCE NO$ 8/31, ADOPTED DECEMBER 16, 1977, AS
AMENDED, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE
FISCAL YEAR ENDING SEPTEMBER 30, 19/8; BY INCREASING
THE GENERAL FUND, DEPARTMENT OF TOURISM PROMOTION IN
THE AMOUNT OF $42,109; AND BY INCREASING THE GENERAL
FUND, ANTICIPATED REVENUES IN THE SAME AMOUNT; FOR
THE MIAMI-MEMO PUBLICITY CONTRACT; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 8731 on December 16,
1977 establishing revenues and appropriations for the City of Miami, Florida
for the fiscal year ending September 30, 1978; and
WHEREAS, said ordinance appropriated a total of $462,891 to the General
Fund, Department of Tourism Promotion for the Miami -Metro Publicity Contract
Division; and
WHEREAS, Dade County Resolution R34-78 for the fiscal year ending
September 30, 1978 authorized a line -item budget of $505,000 for the City of
Miami, Department of Tourism Promotion; and
WHEREAS, it is necessary to appropriate an amount of $42,109 to the
General Fund for the purpose of increasing the Tourism Promotion 1977-78
appropriation from $462,891 to $505,000;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF, THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 1 of Ordinance No. 8731, adopted December 16, 1977, as
amended, is hereby further amended as follows:l/
"Section 1. The following appropriations are made for municipal
operations of the City of Miami, Florida for the fiscal year
1977-78, including the payment of principal and interest on all
General Obligation Bonds.

Section 2. Section 5 of Ordinance No. 8731, adopted December 16, 1977,
as amended, is hereby further amended as follows:1/
"Section 5. The above appropriations are made based upon the
following sources of revenues for the 1977-78 fiscal year.

Section 3. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this ordinance are hereby
repealed.
Section 4. If any section, part of section, paragraph, clause, phrase, or
word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.

2/ Reflects $42,109 increase required for operation of the
Miami -Metro Publicity Contract Division of the Department
of Tourist promotion.
Section S. This ordinance is hereby declared to be an emergency meature
On the groundt of urgent public need for the preservation of peaCe§ health4
Safety, and property of the City of Miami, and upon the further ground Of the
necessity to make the required and necessary payments to its employes and
officers, payment of its contracts, payment of interest and principal on itt
debts, necessary and required purchases of goods and supplies, and to generally
carry on the functions and duties of its municipal affaies.
Section 6. The requirement of reading this ordinance on two separate days
is hereby dispensed with by a vote of not less than four -fifths of the members
of the Commission.

Attached please find proposed legislation for the September 28,
1978, City Commission meeting, as follows:
1) The South Florida Ceta Consortium has informed the City of
Miami that two audit exceptions will be deducted from the next
reimbursement claim for CETA Title II. (See Barry Evans' June
19, 1978 letter to Robert Krause, Re: Audit Report, Ceta Title
II, City of Miami 8/1/74-9/30/75.) These exceptions include
charges of $50 for a conference attended by the City of Miami
Assistant Manpower Coordinator and $7,697 for wages and benefits
paid to a native Haitian who lacked proper authorization to work
in the United States. Funds to cover the total of $7,747 in
disallowed charges are available in the General Fund, Special
Programs and Accounts, Fee Waivers. The attached proposed res-
olution establishes a new line -item account in Special Programs
and Accounts entitled: "Contribution for CETA Reimbursement"
to effect this transaction.
2) An amount of $462,891 was appropriated by the City of Miami
Department of Tourism Promotion, Miami -Metro Publicity Contract
Division for the 1977-78 fiscal year. However, Dade County
Resolution R34-78 for the fiscal year ending September 30, 1978
authorized a line -item budget of $505,000. In a memo dated
August 17, 1978, M.R. Stierheim, County Manager, indicated that
a reduction in the city's final reimbursement would result from
an audit report reflecting the reduced appropriation. The attached
proposed ordinance, therefore, appropriates the balance of $42,109
to the General Fund, Department of Tourism Promotion for the
Miami -Metro Publicity Contract Division.

We have reviewed our budget with the City of Miami's budget and have
determined that if the fourth quarter payment of $126.250 Is paid as will
have overpaid the Joint Publicity and Advertising Program by $31,372.
Our original line iteaa budget of $505,000 was authorised by aisolution
1t34-78 for the fiscal year ending 9-30-78. The City of Miami's line item
budget vas in the amount of $460i39g$ %e have adjusted the b'zdset's line
items to reflect the lower of each line item. We have also reflected
increases in the line items of Vrinting Outside end Miami - Metro Special
Promotions as authorised by Hr. Dewey dni ht. An adjusted line item budget
of $473.628 is attached for your assistance.
ue,are recommending that an amount of $94,3713.00 only be remitted se our
4th quarter payment. Any unresolved amounts will be naudted through our
regular audit which is now in progress.
