A RESOLUTION CERTIFYING AND DECLARING THE
FOLLOWING RESULT OF THE SPECIAL MUNICIPAL
ELECTION HELD OCTOBER 5, 1978 WITH RESPECT
TO THE AUTHORIZATION OF SOUTHERN BELL
TELEPHONE COMPANY, ITS SUCCESSORS
AND ASSIGNS, TO ESTABLISH, INSTALL, CONSTRUCT,
OPERATE AND MAINTAIN ITS TELEPHONE POLES,
WIRES AND OTHER TELEPHONE EQUIPMENT AND
FACILITIES, ALONG, UPON, ACROSS AND UNDER
THE PUBLIC STREETS, LANES, ALLEYS, AVENUES,
BOULEVARDS AND OTHER PUBLIC HIGHWAYS IN THE
CITY OF MIAMI: DISAPPROVED.
BE IT RESOLVED BY THE COMMISSION OF THE
MIAMI, FLORIDA:
Section 1. The returns of the Special Municipal
Election held on October 5, 1978 having been received from
the election officials of each of the voting precincts within
the City of Miami and the Commission having duly canvassed
returns hereby declares:
(a) Said election was duly and properly held and
notice thereof was duly given in accordance with law and
Resolution No. 78-495,passed and adopted July 27, 1978, author-
izing the Southern Bell Telephone and Telegraph Company, Incor-
porated, its successors and assigns, to establish, install,
construct, operate and maintain its telephone poles, wires and
other telephone equipment and facilities, along, upon, across
and under the public streets, lanes, alleys, avenues, boulevards
and other public highways in the City of Miami, subject to all
Provisions, terms and conditions in Ordinance No. 8819.
(b) All steps in connection with the leading up to
Special Municipal Election were duly, regularly and law
fully taken and had; and all applicable provisions of the Con-
stitution and Statutes of the State of Florida and of said

"Shall the measure known as Ordinance No.
8819 passed and adopted on the 22nd day of
June, 1978, and entitled 'AN ORDINANCE GRANTING
TO SOUTHERN BELL TELEPHONE AND TELEGRAPH COMPANY,
ITS SUCCESSORS AND ASSIGNS, A FRANCHISE GRANTING
THE RIGHT TO THE USE OF PUBLIC RIGHT OF WAY TO
INSTALL NECESSARY TELEPHONE EQUIPMENT; PROVID-
ING FOR ONE PERCENT FRANCHISE FEE, INCREASING BY
ONE PERCENT IN EACH OF TWO SUCCEEDING YEARS AT
THE SAME TIME AND RATE THE FEDERAL EXCISE TAX IS
REDUCED; PROVIDING FOR ALL PAYMENTS IN EXCESS OF
ONE PERCENT TO BE DEPOSITED IN A TELEPHONE FRAN-
CHISE PUBLIC CONSTRUCTION RESERVE ACCOUNT, IMPOS-
ING PROVISIONS AND CONDITIONS; REPEALING ALL
ORDINANCES IN CONFLICT AND CONTAINING A SEVERABILITY
PROVISION' be approved or disapproved?"
(e) Each qualified elector of the City of Miami was
the opportunity of voting for or against the question.
Section 2. It is hereby found and determined that
701 votes were cast by qualified electors in favor of the
question; that 10,132 votes were cast by qualified electors
against the question; that the Commission hereby declares
and certifies that the authorization of Southern Bell Telephone
and Telegraph Company, its successors and assigns, to establish,
install, construct, operate and maintain its telephone poles,
wires and other telephone equipment and facilities, along, upon,
across and under the public streets, lanes, alleys, avenues,
boulevards and other public highways in the City of Miami, was
disapproved by the qualified electors of the City of Miami at
said Special Municipal Election; that the total number of
ballots cast at said Special Municipal Election in the 87 voting
precincts, including 394 absentee ballots, was 15,833, and

I, RALPH G. ONGIE, City Clerk of the City of Miami, Florida, do
hereby certify that all necessary legal steps in connection with the
conducting of a Special City of Miami Election held on October 5, 1978,
Were followed, i.e., logic and accuracy tests were held on Tuesday,
October 3, 1978, at 8:30 a.m. at the Data Processing Division, Metro
Justice Building, using dummy ballots to determine that the computer
was functioning correctly, and a similar test was conducted beginning
at 5:00 p.m., on election night, Thursday October 5, 1978, and that all
documents concerning these logic and accuracy tests show the computer
to be functioning correctly and are in the possession of the Supervisor
of Elections of Metropolitan Dade County, under sealed vault.
I further certify that the aforesaid election was conducted in
accordance with the provisions of the "Electronic Voting Systems Act,"
(F.S. 101.5601 through 101.5615).
