WHEREAS, the Off -Street Parking Board of the City of Miami has recommended to the City Commission that parking rates be increased in Municipal Parking Garage No. 2, upon recommen- dation of the Parking Consultant; and WHEREAS, the Parking Consultant has personally inspected Municipal Parking Garage No. 2 and carefully reviewed the exist- ing rate structure; and WHEREAS, the Parking Consultant has submitted a letter dated July 5, 1978, recommending that the rates be increased at Municipal Parking Garage No. 2, to be effective December 1, 1978, in order to meet the costs of operation; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following designated parking rates in Municipal Parking Garage No. 2, located at 130 Biscayne Boulevard, are hereby established: Hourly Rate Evening (6 P.M. - Mid.) Night (Mid. - 7 A.M.) Overnight (6 P.M. - 7 A.M.) Monthly Rate FROM TO $ .45 per hour $ .50 per half hour 1.00 2.00 1.00 2.00 1.50 2.50 35,00 37.50 Section 2. The rates as provided in this Ordinance shall be effective at 12;01 A.M., December 1, 1978, Section 3. All acts of the Off -Street Parking Board and its Director as to rates heretofore charged are hereby ratified and confirmed, `r Section 4. Ail rifdinancas or parts thereof in conflict herewith are repealed insofar as they are in conflict. Section Ss The bleector of Off=Street parking shall cause certified copies of this ordinance to be filed pursuant to Section SO3 of the Trust indenture, Section 6. If any section, sentence, clause, phrase, or word of this ordinance is for ahy reason held or declared to be unconstitutional, inoperative or void, such holding or invalidity shall not affect the remaining portions of this ordinance, and it shall be construed to have been the intent of the Commission of the City of Miami to pass this ordinance without such unconstitutional, invalid, or inoperative part therein; and the remainder of this ordinance, after the exclusion of such part or parts shall be deemed and held to be as valid as if such parts had not been included therein. At the July 26, 1978 meeting of the Off -Street Parking Board, Resolution No.78.-578 was passed accepting the report of our Parking Consultant, recommending that the City Commission authorize rate adjustments in Municipal Parking Garage No.2, to be effective December 1, 1978, and instructing the Director to implement the new rate schedule after the City Commission authorizes the changes. Enclosed is our Resolution and a copy of the proposed City Commission Ordinance authorizing the rate adjustments. Will you kindly place this item on your agenda for the next City Commission meeting. I 8 V n^ 8 R R 3 RESOLUTION NO. 78.578 ACCEPTING THE JULY 5, 1978 LETTER FROM CONRAD ASSOCIATES A$T, RECOMMENDING TO THE CITY COMMISSION THAT THEY AUTHORIZE RATE INCREASES AT MUNICIPAL PARKING GARAGE NO. 2, TO BE EFFECTIVE DECEMBER 1, 1978, AND INSTRUCTING THE DIRECTOR TO IMPLEMENT THE RATE CHANGES AFTER THE CITY COMMISSION AUTHORIZES THE CHANGES WHEREAS, Mr. Howard R. May of Conrad Associates East has personally inspected Municipal Parking Garage No.2 and carefully reviewed the existing rate structure, and has submitted a letter dated JulY,5, 1978 recommending that the rates be increased at Garage No.2, as listed herein; and WHEREAS, the Off -Street Parking Board concurs with the recom- mendations of Conrad Associates East, to increase the rates in the subject parking garage in order to meet the cost of operation; NOW, THEREFORE, BE IT RESOLVED BY THE OFF-STREET PARKING BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1.
