I� 7 8 « 8 2 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF THE VARIANCE AS LISTED IN ORDINANCE NO. 6871, ARTICLE XI-1, SECTION 4 AND ARTICLE XXVI, SECTION 2(30)(b), TO PERMIT CONSTRUCTION OF A SAVINGS AND LOAN INSTITUTION (PROPOSED BRICKELL SAVINGS AND LOAN ASSOCIATION) ON LOTS 5 THROUGH 10, BLOCK 57; (LYING NORTHEASTERLY OF FEDERAL HIGHWAY) FLAGLER MARY BRICKELL (5-44), BEING 2651 SOUTH MIAMI AVENUE, AS PER SITE PLAN ON FILE, WITH 10.0' FRONT YARDS (30' REQUIRED) AND 39' BUILDING HEIGHT IN THREE STORIES (25' HEIGHT OR TWO STORIES ALLOWED), AND SUBJECT TO YARD APPROVAL BY THE ENVIRONMENTAL PRESERVATION BOARD ON THAT PART ABUTTING SOUTH MIAMI AVENUE (A SCENIC " S U P PO RTfV PRANSPORTATION DSUBJECTO CORRIDOR); :()NOFUTUREED R-CA EXPANSION, (2)rrTIAL ICE) CONFINED 4J0`vU WI E,`+TIJSAVINGS AND AACTIVITIES TO APPROVALOFFINALLPLANSBYTHE PLANNING DEPARTMENT. FOLLOW" WHEREAS, Article XXXI of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a Variance by the City Manager with approval by the City Commission for a period of one year; and WHEREAS, the City Manager recommends a one year extension of the Variance granted by the Zoning Board by Resolution No. ZB 46-78; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: "DOCUMENTINDEX ITEM N + Section 1. The request for a one year ex ension or the Variance as listed in Ordinance No. 6871, Article XI-1, Section 4 and Article XXVI, Section 2(30)(b), to permit construction of a savings and loan institution (proposed Brickell Savings and Loan Association) on lots 5 through 10, Block 57, (lying northeasterly of Federal Highway) Flagler Mary Brickell (5-44), being 2651 South Miami Avenue, as per site plan on file, with 10.0' front yards (30' required) and 39' building height in three stories (25' height or two stories allowed), and subject to yard approval by the Environmental Preservation Board on that part abutting South Miami Avenue ( a scenic transportation corridor), zoned R-CA (Residential Office), and subject to: (1) No future expansion, (2) Confined to Savings and Loan activities only, and (3) Subject to approval of final plans by the Planning Department granted by Zoning Board Resolution No. ZB 46-78 be and the same is hereby granted. Miami Avelhue ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871 provides that any Variance shall expire six months after the effective date of the Variance unless a Building Permit or a Certificate of Use has been issued based upon the Variance. The Ordinance further provides that the City Manager may, after reveiw and determination that sub- stantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Variance for an additional period of time not to exceed one year, subject to approval of the City Commission. This Department finds no objection to the granting of the extension of time for this Variance. Miami, Florida Dear Mr. Grassie: I am requesting a one year extension of the variance granted by the City of Miami Zoning Board on March 6, 1978 by Resolution #ZB46-78. Although substantial progress has been achieved in terms of project planning, construction is not ready for commencement. If further explanation or information is necessary please advise.
