ORDINANCE NO 4 S 7 2
AN ORDINANCE AMENDING ORDINANCE NO, 6871, THE
COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF
MIAMI, BY CHANGING THE ZONING CLASSIFICATION OP
NORTHERLY 1/2 OF 20' PUELIC ALLEY (PROPOSED TO
BE VACATED) LYING NORTHERLY OF DOTS 9 AND 10,
ELOCR 3, WHITEHEAD AND ELAIR SUB (4448), BEING
APPROXIMATELY 4101 N.14, 7TH STREET, FROM R-1
(ONE FAMILY DWELLING) TO GU (GOVERNMENTAL USE),
AND BY MAILING THE NECESSARY CHANGES IN THE ZONING
DISTRICT MAP, MADE A PART OF THE SAID ORDINANCE
NO, 6871, BY REFERENCE AND DESCRIPTION IN ARTICLE
III, SECTION 2 THEREOF; BY REPEALING ALL ORDINANCES,
CODE SECTIONS, OR PARTS THEREOF IN CONFLICT, AND
CONTAINING A SEVERABILITY PROVISION,
WHEREAS, the Miami Planning Advisory Board, at its meeting
of July 19, 1978, Item No. 1(a), following an advertised hear-
ing, adopted Resolution No. PAB 39-78 by a 4 to 0 vote (4
members absent) recommending change of zoning classification
as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration
of this matter, deems it advisable
the general welfare of the City of
and in the best interest of
Miami and its inhabitants
to grant a change of zoning classification
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami be, and the same is hereby amended
by changing the zoning classification of Northerly 1/2 of 20'
public alley (proposed to be vacated) lying northerly of Lots
9 and 10, Block 3, WHITEHEAD AND BLAIR SUB (44-78), being approxi-
mately 4101 N.W. 7th Street, from R-1 (One Family Dwelling) to
GU (Governmental Use), and by making the necessary changes in
the zoning district map made a part of the said Ordinance No,
6871 by reference and description in Article III, Section 2
thereof,
Section 2. That all laws or parts of laws in conflict
as
hereinafter set

are it conflict.
Section 5, Should any part or provigion of thig Ordinance
be declared by a court of competent jurigdiction to be invalid
the gate shall not affect the validity of the ordinance ag a

ARTICLE XXI-2 GU GOVERNMENTAL USE, Section 3
(1-2): zoned GU GOVERNMENTAL USE except for the
northerly s of the ally (proposed to be vacated)
which is zoned R-1 ONE -FAMILY DWELLING and
proposed to be rezoned GtJ GOVERNMENTAL USE.,
REQUEST To bring zoning and permission to construct into con-
formity with the revised plans for Fire Station #10.
BACKGROUND Rezoning of Lots 9 and 10 to Governmental Use and
permission to construct and operate Fire Station #10
were recommended by Resolution PAB 40-77 and 41-77
dated September 7, 1977 and adopted by the City Com-
mission by Ordinance 8727 dated November 10, 1977
and Resolution R-77-825 dated October 20, 1977.
Two factors have served to bring this item back for
further consideration. The City has secured reversion
rights to the northerly 1 of the alley north of the
site. Upon proposed vacation of the alley, the south-
erly 1 of the alley reverts to the City as GU zoning.
It is now in order to consider re -zoning the northerly
1/ alley from R-1 to GU. Secondly, the bids received
for the original Fire Station #10 remodeling came in
much higher than the project budget so that the facility
has now been designed from two stories to one story.
The present one-story proposal occupies more of the site,
than the original proposal recommended by the Planning.
Advisory Board and approved by the City Commission so that
re-Lonsideration is considered appropriate.

to the west so that the total floor area would be
6700 square feet. The maximum station complement
at any one time is 11; 8 on -site parking spaces are
provided, Vacation of the alley to the north would
enlarge the site to 18,150 square feet.
Setbacks are 15' at the side street and 19' on NW 7th
Street.
APPROVAL. of a) the zoning change and b) construction
and operation of the fire station addition per site plan
submitted and on file.
Approval of Governmental Use in this District is based
on the following factors:
a) Fire Station #10, and the addition are compatible
with the adjacent commercial uses, zoned C-4 on
NW 7th Street and provide a buffer between the
traffic on NW 7th Street and residential areas to
the north, zoned R-1.
b) Fire Stations as public facilities can be established
in any zoning district (Article IV Section 35), and
are considered compatible with the Miami Comprehen-
sive Neighborhood Plan.
c) The site is located directly facing an arterial
.Street (NW 7th Street) which provides excellent
direct access, while the parking area is accessible
from both NW 41st Avenue and NW 7th Street.

such as landscaping and setbacks.
The expansion of Fite Station 1110 is essential
for fire protection for this portion of the
City as described in the Miami PireProtection,
and Emergency 5erVices Master Plan. 1977-1987
Recommended APPROVAL„ July 19, 1978, by a 4-0
vote.
