AN 'ORDINANCE AMENDING ORDINANCE NO. 6871, THE COMPREHENSIVE ZONING ORDINANCE POR THE CITY OF MIAMI, BY CHANCING THE ZONING CLASSIFICATION OP TENTATIVE PLAT NO. 1020 "LEMON CITY PARK", BEING APPROXIMATELY 56-42 N,E, 59Ttt STREET, PROM R=2 (TKO FAMILY DWELLING) AND Rm3 (LOW DENSITY MULTIPLE DWELLING) TO PR (PUBLIC PARK AND RECREATIONAL USE DISTRICT) ,AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP, MADE A PART OP THE SAID ORDINANCE NO. 6871, BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOP; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS TREREOP IN CONFLICT, AND CONTAINING A SEVERABILIT? PROVISION. WHEREAS, the Miami Planning Advisory Board, at its meeting of July 12, 1978, Item No. 3(a), following an advertised hearing, adopted Resolution No. PAB 34-78 by a 6 to 0 vote (2 members absent) recommend- ing changing the zoning classification as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant a change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami be, and the same is hereby amended by changing the zoning classification of Tentative Plat No. 1020 "LEMON CITY PARK", being approximately 36-42 N.E. 59th Street, from R-2 (Two Family Dwelling) and R-3 (Low Density Multiple Dwelling) to PR (Public Park and Recreational Use District), and by making the necessary changes in the zoning district map made a part of the said Ordinance No. 6871 by reference and description in Article III, Section 2 thereof. Section 2. That all laws or parts of laws in conflict herewith be and the same are hereby repealed insofar as they are in conflict. Sddtiot 3. BACKGROliND ANALYSIS This site has previously been considered for some public or quasi public use. The 15 platted lots involved were under three (3) ownerships simply- fyina land assembly. In Oct -Nov. of 1973 the 8 lots on the east 1/2 of this site came before the Zoning Board and the City Commission in an attempt to establish a non-profit therapeutic center, (Village South) which was denied. This site consists of 2.27 acres acquired through purchase and a street closure (by plat) forming a single parcel of approximately 2 1/2 acres. Located in an area of duplexes & multi family housing, this facility will serve an important neighborhood need. The nearest existing recreational facility is over 1/2 mile from this site. (Edison Community Park). The proposed development includes utilization of an existing single family structure and a duplex structure.
