AN ORDINANCE AMEND/NO SECTION 2,44 OF THt CODE OF THE CITY OP tMIAMI, PtORIDA, AS AMRNDt b, RY PROVtbINO A 1:Rt; FOR Mk/With/NARY St RVtCt S IN CONNECTION WITH ttt PRObtiCtION of RECORDS, PLANS AND MAPS ON Pitt WITH tHt tOtLoiNC AND ZONING iNSPRCTION Dt DARTMRNT; CONTAINING A RRI't ALER HRoVISioN, A S1 VtRAt3ttITY CLAUSE AND PROVIDINC FOR AN > SFt;CTtVR DATE WHEREAS, the building and Zoning Inspection Department of the City of Miami is required to spend significant amounts of time for searching of records when requested by the general public and either conveying the information verbally, or, allow- ing the person to view the records, or, reproducing the records for the person seeking the information; and WHEREAS, the custodian of public records by law may not impose a fee for the inspection of public documents; and WHEREAS, the right of citizens to inspect public records may not be preconditioned on the payment of a fee; and WHEREAS, the City Manager recommends that a fee be established to partly reimburse the City for its actual costs involved in making certain services available to the public above and beyond the legal duty imposed upon the Building and Zoning Inspection Department to insure access to public records; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2-24 of the Code of the City of Miami, Florida, as amended is hereby further amended by repealing it in its entirety and substituting therefor the following:. "Sec. 2-24. Fees for extraordinary services in connection with reproduction of records, plans and maps, including those on microfilm, A fee is hereby established for furnishing services in connection with the reproduction of records, plans and maps, including those on microfilm, of the building and zoning inspection department, as follows; EERVICi ( a) 5e curifig and f utfitishing requested infattation frdm record on file (not iticiudittg microfilm) includes search by city employees if legal description of property involved hot furnished at tithe of request; may include oral or written report on contents of records, plans and taps . . . 6464 { . . . . . . 66 44 i . . . . . . All ordinances or parts of ordinances in con— flict herewith, insofar as they are in conflict, are hereby repealed. Section 3. Should any section, part of section, paragraph, clause, phrase, or word of this ordinance be declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4.
