A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE IN
LIEU OF CONDEMNATION, A DUPLEX COMPRISED OF A LAND AREA
OF 6750 Sp. FT., AND BUILDING OF 1604 SQ, FT., LOCATED
AT 1105 S.W. SECOND AVENUE, MIAMI, FLORIDA, FOR THE SUM
OF SIXTY THOUSAND ($60,000.00) DOLLARS, AND ALLOCATING
SIXTY-ONE THOUSAND FIVE HUNDRED ($61,500.00) DOLLARS FROM
FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITY BOND
FUNDS TO COVER THE COST OF ACQUISITION OF FEE SIMPLE TITLE

WHEREAS, the property located at 1105 Southwest Second Avenuer
Miami, Florida, is proposed to be acquired for Fire Station #4; and
WHEREAS, the Fire Department has approved the acquisition of this
property to provide for Fire Station #4, and concurs with the recommendation
to acquire this parcel; and
WHEREAS, funds from Fire Fighting, Fire Prevention & Rescue Facility
Bonds, as identified in Paragraph B, Subparagraph 3 of the General Obligation
Bond Appropriation Ordinance #8716 are available to acquire said parcel; and
WHEREAS, the owner of the property has by Agreement dated the 21st
day of September, 1978, offered to convey fee simple title to this property
to the City of Miami, Florida, for the negotiated price of Sixty Thousand
($60,000) Dollars; and
WHEREAS, it is deemed in the best interests of the City of Miami,
Florida to acquire the property at this time

Per memorandum dated August 17, 1977 from Chief D. A. Hickman, Director, Department
of Fire, authorization was received to acquire property for the relocation of Fire
Station #4. This acquisition is the third of four parcels to be acquired to
complete the total acquisition.

Funds are available for this purchase from the Fire Fighting, Fire Prevention &
Rescue Facility Bond Fund to cover the cost of this acquisition. In considering
this acquisition, all factors were reviewed. The fact that if the City were to
institute condemnation proceedings predicated on the $47,030 offer, it was felt that
attorney's fees would be at least 15":. to 20A of the asking price which would be
$6,000 to $8,000 plus Court costs, and an interminable delay in the process to
acquire. In addition, we must prove to the Court the need and necessity of
acquiring this property for public use, which we have been denied in the past
in other condemnation cases.

It was agreed by the members of the negotiating committee which is composed
of the Property Manager and members of the Fire Department that in order
to acquire this parcel the increase over the appraised value of the purchase
price is warranted.
It is recommended that this property be acquired for the negotiated price of
$60,000.00. The Department of Fire concurs with this recommendation.
