AN ORDINANCE AMENDING ORDINANCE NO 6871, THE
COMPREHENSIVE ZONING ORDINANCE FOR THE CITY b1
MIAMI, ARTICLE XI RESIDENTIAL OFFICE RR4 DISTRICT,
SECTION 1, BY DELETING SUBSECTION (2) IN ITS
ENTIRETY AND IN LIEU THEREOF SUBSTITUTING A NEW
SUB -SECTION (2) TO READ AS FOLLOWS: APARTMENT
BUILDING NOT EXCEEDING A DENSITY OF ONE (1)
DWELLING UNIT FOR EACH ONE THOUSAND FIVE HUNDRED
(1,500) SQUARE FEET OF LOT AREA FOR BUILDINGS
CONTAINING PROM POUR (4) TO TWELVE (12) UNITS
AND A DENSITY OF ONE (1) DWELLING UNIT FOR EACH
ADDITIONAL FIVE HUNDRED AND FIFTY (550) SQUARE
FEET OF LOT AREA FOR BUILDINGS CONTAINING MORE THAN
TWELVE (12) UNITS, PROVIDED THAT, IN HOUSING FOR THE
ELDERLY, THE DENSITY SHALL NOT EXCEED ONE (1)
DWELLING UNIT FOR EACH FOUR HUNDRED AND FIFTY (450)
SQUARE FEET OF LOT AREA FOR BUILDINGS CONTAINING
MORE THAN TWELVE (12) UNITS; AND BY MAKING THE
NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A
PART OF SAID ORDINANCE NO. 6871 BY REFERENCE AND
DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF; BY
REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS
THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY
PROVISION.
WHEREAS, the Miami Planning Advisory Board, at its
meeting of September 20, 1978, Item No. 2, following an advertised
hearing, adopted Resolution No. PAB 46-78 by a 5 to 2 vote (1 member
absent) recommending amending Ordinance No. 6871, the Comprehensive
Zoning Ordinance, as hereinafter set forth; and
WHEREAS, the Commission deems it advisable and in the
best interest of the City of Miami and its inhabitants to amend said
Ordinance as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami, Article XI Residential Office R-C
District, Section 1, be and the same is hereby amended by deleting
Sub -section (2) in its entirety and in lieu thereof substituting a
new Sub -Section (2) to read as follows;
(2) Apartment building not ekeeeding a density of
one (1) dwelling unit for each one thousand
fie hundred (1,500) square feet of lot area for
buildings containing from four (4) to twelve (12)
units and a density of one (1) dwelling unit for
each additional five hundred and fifty (550) square
feet of lot area for buildings containing more than
twelve (12) units, provided that, in housing for the
elderly, the density shall not exceed one (1)
dwelling unit for each four hundred and fifty (450)
square feet of lot area for buildings containing
more that twelve (12) units;
and by making the necessary changes in the Zoning district map made
a part of said Ordinance No. 6871 by reference and description it
Article III, Section 2 thereof,
Section 2. That all laws or parts of laws in conflict
herewith be, and the same are hereby repealed insofar as they are in
conflict.
Section 3. Should any part or provision of this Ordinance
be declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the Ordinance as a whole.
