APARTMENT BUILDING NOT EXCEEDING A DENSITY OP ONE (1) DWELLING UNIT FOR EACH ONE THOUSAND FIVE HUNDRED (1,500) SQUARE FEET 0P LOT AREA FOR BUILDINGS CONTAINING FROM FOUR (4) TO FIFTEEN (15) UNITS AND A DENSITY OF ONE (1) DWELLING UNIT FOR EACH ADDITIONAL SEVEN HUNDRED AND FIFTY (750) SQUARE FEET OF LOT AREA FOR BUILDINGS CONTAINING MORE THAN FIFTEEN (15) UNITS, PROVIDED THAT, IN HOUSING FOR THE ELDERLY, THE DENSITY SHALL NOT EXCEED ONE (1) DWELLING UNIT FOR EACH SIX HUNDRED (600) SQUARE FEET OF LOT AREA FOR BUILDINGS CONTAINING MORE THAN FIFTEEN (15) UNITS, AND BY MAXING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OP SAID ORDINANCE N0. 6871 BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY PROVISION. WHEREAS, the Miami Planning Advisory Board, at its meeting of September 20, 1978, Item No. 2, following an advertised hearing, adopted Resolution No. PAB 45-78 by a 5 to 2 vote (1 member absent) recommending amending Ordinance No. 6871, the Comprehensive Zoning Ordinance, as hereinafter set forth; and WHEREAS, the Commission deems it advisable and in the best interest of the City of Miami and its inhabitants to amend said Ordinance as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami, Article VIII Medium Density Multiple R-4 District, Section 1, be and the same is hereby amended by deleting sub -section (9) in its entirety and in lieu thereof substituting a new sub -section (9) to read as follows; (9) Apartment building not exceeding a density of one (1) dwelling unit for each one thousand five hundred (1,500) square feet of lot area for building containing from four (4) to. fifteen (15) units and a density of one (1) dwelling unit for each additional seven hundred and fifty (750) square feet of lot area for buildings containing more than fifteen (15) units, provided that, in housing for the elderly, the density shall not exceed aid (15 dwelling unit for each six hundred (6005 square feet of lot area for buildings eotttain- ing more than fifteen (155 units; and by making the necessary changes in the toning district snap Made a part of said Ordinance No, 6871 by reference and description in Article tit, Section 2 thereof, Section 2, That all laws or parts of laws it conflict herewith be, and the same are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole.
