ORDINANCE 6871, ARTICLE VIII, SECTION 1 (11)(f),
To PERMIT AN ELEEMOSYNARY INSTITUTION (MIAMI ADULT
CENTER Fo1 RETARDED, INc,) ON LOT 18, BLOCR 6,
INCLEWOob GARDENS (13-57) BEING 126=128 N,E, 63RD
STREET, AS PER SURVEY ON FILE, AND SUBJECT TO A
CHANCE OF ZONING CLASSIFICATION FROM R-3 TO R=4,
WHEREAS, the Miami Zoning Board, at its meeting of Ally
17, 1978, Item #2(b), following an advertised heating, adopted
Resolution No, ZB 141-78 by a 7-0 vote denying conditional use
as hereinafter set forth; and
WHEREAS, the City Commission, notwithstanding denial by
the Miami Zoning Board, and after careful consideration and
due deliberation of this matter, deems it advisable and in the
best interests of the City of Miami and its inhabitants to
grant said conditional use, as hereinafter set forth
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OE THE NUEX
CITY OF MIAMI, FLORIDA:

Section 1. Conditional Use, as listed in'Ordinance
Article VIII, Section 1 (11)(f), to permit an eleemosynary
institution (Miami Adult Center for Retarded, Inc.) on Lot 18,
Block 6, INGLEWOOD GARDENS (13-57) being 126-128 N.E. 63rd
Street, as per survey on file, and subject to a change of zoning
classification from R-3 to R-4, be and the same is hereby
granted.

REQUESTS (a) Chance of Zoning Classification application
from R-3 to R-4
EXPLANATION
(b) Conditional Use application to permit an
eleemosynary institution.(Miami Adult Center
for Retarded Inc.).
(c) Variance application to permit the operation
of an eleemosynary institution (Miami Adult
Center for Retarded Inc.), providing 15 off-
street parking spaces (48 o.s.p. spaces
required) with 8.97' east side yard on Lot
18 (20'• required) .
The Center owns several lots adjacent to Lot 18.
Most of those lots were rezoned from R-3 to R-4 by
City Commission action on 1-28-71 (Ordinance 7932),
and Variances which permitted the operation of the
Center were also granted by the C.C. (Resolution
42126) after both Change of Zoning and the Variances
were denied or denial recommended by the Zoning Board
(Resolution 70-204 and 205 respectively);. The rezoning
of Lot 18 will add a 2 story duplex to the Center's
operation.
The Conditional Use and the Variance are needed to
incorporate Lot 18 with the rest of MAC Town.
Applicant states that the use of the duplexon Lot
18 will be as "a semi-indePendent living unit for
eight high-level retarded individuals..... the
purpose of this living unit shall be to aid retarded
individuals capable of functioning in a semi-
independent manner with making the transition into

a) APPROVAL. The proposed change from E
R,-3 to R-4 zoning is consistent With the
established land Use pattern and With the
Comprehensive Neighborhood Plan, The
intent is to use the existing two-story
duplex as housing for eight members of the
organization, The R-.3 district does hot
permit such a use, whereas with a conditional
Use permit, the R-4 district does.
b) APPROVAL IN ACCORD WITH THE PLANS ON FILE,
SUBJECT TO THE CONDITION THAT THIS USE WILL BE
PERMITTED ONLY AS LONG AS IT MAINTAINS ITS
AFFILIATION WITH THE MIAMI ADULT CENTER FOR
RETARDED FACILITIES ON 6250 NE 1st PLACE, AND
SUBJECT TO THE APPROVAL OF THE CHANGE OF ZONING
AND VARIANCE APPLICATIONS,
In order to function as a viable use, this
conditional use application to permit minimum -
supervision housing for eight retarded indi-
viduals must remain affiliated with all the
facilities at this location, As long as this
is the case, the proposed use meets the condi-
tional use standards. Since this structure
is to function as a residential dwelling, the
proposed use should have little if any impact
upon the existing residential neighborhood.
c) APPROVAL IN ACCORD WITH THE PLANS ON FILE
SUBJECT TO THE CONDITION THAT THE TRASH BINS
BE REMOVED FROM THE PARKING LOT. The applicant
has already received a variance to waive 35 re-
quired parking spaces on the majority of the
site (City Commission Resolution 42126). The
only alteration to the original request has been
the addition of the living facilities on Lot 18,
for which the applicant states that no additional
parking will be required as none of the occupants
drive automobiles. In effect there is no in-
creased demand for parking. The trash bins in
the parking lot must be removed however, to pro-
vide the required parking.
