Bt IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1+ The City Manager is hereby authorized to enter in to an agreement with MARIEPETIT, for her professional. services, as Administrative Assistant to the Mayor, subject to the terms and conditions contained in the contract attached hereto and made a part hereof, with funds therefor in the amount of $21,000 hereby allocated from Code 2001 "Office of the Mayor" from currently budgeted funds. The ADMINISTRATIVt ASSISTANT To THE HAYoR shall be en titled to two (2) Weeks vacatidh ftoM the duties prescribed it this Agteettteflt and shall be paid according to the teguar biweekly payment of compensation during such vacation period, E, The ADMINISTRATIVE ASSISTANT TO THE MAYOR shall be deemed an independent contractor and not an agent or employee of the CITY, and shall not attain any rights or benefits under the Civil Service Pension Ordinances of the CITY, or any rights generally afforded classified or unclassified employees, except. she may be provided health insurance under the ,CITY' S policy; further she shall not be deemed to be entitled to i;lorida Work- men's Compensation benefits as an employee of the CITY', and the CITY shall exercise no control over the manner or means whereby the services of the ADMINISTRATIVE ASSISTANT TO THE MAYOR are performed, except (1) as to the ultimate accomplishment of the objective as herein set forth; and (2) she shall devote her entire time and attention to such duties, and shall not engage in any other business, profession, or commercial activity. III. PERFORMANCE The ADMINISTRATIVE ASSISTANT TO THE MAYOR'S professional services and work product shall consist of the following: A. Receive on behalf of the Mayor inquiries or from private citizens. Prepare at the request of the Mayor, letters, memoranda or other documents as may be required by the Mayor. If the Mayor desires, these may be prepared for the Mayor's signature, In the event the Mayor requests the ADMINISTRATIVE ASSISTANT TO THE MAYOR to affix her signature to any letter or document, the ADMINISTRA- TIVE ASSISTANT TO THE MAYOR will indicate that she has affixed the Mayor's signature by placing her initials beside the signature. of the Mayor that she has affixed to the letter or document, C, Represent the mayor at public meetings only when requested to do so by the Mayer, In such case, when the ADMINIS- TRATIVE ASSISTANT TO THH MAYOR is representing the Mayor at any Er 2 . THIS' ACRt tM8NT made and entered into this ,._ day of 197 3 by and hetween the CITY Ot' t•tIAMI, Vlotida5 (hereinafter referred to as the "CITY")s and MARIE PETIT, (Hereinafter referred to as the "ADMINISTRATIVE ASSISTANT TO THE MAYOR"), IN CONSIDERATION of the mutual covenants attd agreements hereinafter set forth the patties hereto covenant and agree as. follows: I. -TERM The term of this Agreement'' for the services of the ADMINISTRATIVE ASSISTANT TO THE MAYOR shall be for a period one (1) year commencing and terminating on subject to the right of either party hereto to cannel this contract upon giving thirty (30) days prior written notice. II. COMPENSATION A. The ADMINISTRATIVE ASSISTANT TO THE MAYOR Shallao, receive compensation for her services at the rate of $143,'&0per year, payable in equal biweekly installments. Said amount shall constitute full compensation to be paid the ADMINISTRATIVE ASSISTANT TO THE'MAYOR for the professional services and work product stated herein; however, it is agreed that deductions Social Security Membership will be matched by the .CITY; and it. is further agreed that the CITY will deduct applicable Federal Withholding Taxes. B. The ADMINISTRATIVE ASSISTANT TO THE MAYOR shall not enter into any written contracts, documents or legal instruments or make any oral representations that bind or obligate the CITY, C: All state and county lawsand those provisions regard conflict of interest in Section 4(c) of the Charter of City of Miami, Florida, and the provisions of the conflict interest ordinance of the City of Miami are applicable ADMINISTRATIVE ASSISTANT TO THE MAYOR and she shall be those provisions. D.
