A RESOLUTION APPROVING, RATIFYING AND
CONFIRMtNC, THE ACTION OF Tilt CITY ATTORNEY
REOARDtNC, THE EMPLOYMENT 0P THE LAW FIRM OF
SNYDER, YOtUNG, STERN, BARRETT &-TANNENBAUM.
TO REPRESENT THE CITY OF MIAttI IN THE CASE
or JOSEPH COOK V, CITY 0F MIAMI, ET ALr , U.S.
DISTRICT COURT, SOUTHERN DISTRICT OF FLORIDA,
CIVIL ACTION #78-3225-CIV-JG; FURTHER AIJTHORI7-
ING THE PAYMENT OE? $10,339.40 TO THE. SAID LAW
FIRM WITH FUNDS THEREFOR' ALLOCATED FROM THE
SELF-INSURANCE TRUST FUND; LIMITING THE TOTAL
PAYMENT TO SAID LAW FIRM TO $ 30 , 000. UNLESS
FURTHER AUTHORIZED BY THE CITY COMMISSION:
WHEREAS, JOSEPH COOK, a City of Miami Police Officer
assigned to undercover duty,was injured by uniformed police
officers of the Miami Police Department during the course of
performing his undercover duties on September 3, 1974; and
WHEREAS, in addition to pursuing his Workmen Compen-
sation remedy, the said JOSEPH COOK has filed suit in the
Federal District Court seeking relief under Civil Rights
Statutes; and
WHEREAS, the City's liability insurance carrier
denied coverage and protection to the City of Miami
and
refused to :appear and defend the City in the aforesaid lawsuit;
and
WHEREAS, the interests of the City of Miami are
`best served by the retention of legal counsel
in the field of insurance; and
WHEREAS, the nature of the suit involving the issue
of coverages, as well as the issue of liability, such that
immediate Diction was necessary; and

WHEREAS, due to the exigency of circumstances
City Attorney has entered into an interim agreement for pro-
fessional services in the aforesaid litigation with the law
firm of Snyder, Young, Stern,
Barrett & Tannenbaum,

WHEREAS, the City Commission desires to ratify
the aforesaid action of the City Attorney;
NOW, THEREFORE, 13L' IT RESOLVED BY THE COMMISSION
Or THE CITY OF MIAMI, FLORI.DA:
Section 1.. The prior action of the. City Attorney
regarding the employment of the law firm of Snyder., Young,
Stern, Barrett & 'Tannenbaum in connection with representing
the City of Miami in the case of Joseph Cook v. City of
Miami, et a1., U.S. District Court; Southern District of
Florida, Civil. Action E78=3225-CIV-JC, is hereby approved
ratified and confirmed. The fees payable to said law firm
are as follows:
Services of senior partner$125 per hour
Services of junior partner $100 per hour
Section 2. Payment of the sum of $10,339.40 to the.
law firm of Snyder, Young, Stern, Barrett & Tannenbaum, for
professional services rendered in the above lawsuit is hereby
approved with funds allocated therefor from the Self -Insurance
Trust Fund, with total payment being hereby limited to $30,000 unless further
authorized by the City Commission.
PASSED AND ADOPTED this 14th day of December, 1978.
