A RESOLUTION AUTHORIZING THE CITY MANAGER
OF THE CITY OF MIAMI TO EXECUTE AN AGRCC-
MENT SUBSTANTIALLY IN ACCORDANCE t4ITH THE
TERMS AND CoND1TIONS SET FORTH IN THE
ATTACHED AGREEMENT WITH METROPOLITAN DADS
COUNTY, MONROE COUNTY, THE CITY OF HIALtAH
AND THE CITY OP MIAMI BEACH TO PARTICIPATE
IN THE SOUTH FLORIDA EMPLOYMENT ANI) TRAIN-
ING CONSORTIUM; FURTHERS APPROVING, AUTHOR-
IZING AND APPOINTING THE CITY MANAGER OF
THE CITY OF MIAMI TO SERVE AS THE REPRESEN-
TATIVE FOR THE CITY OF MIAMI TO SAID SOUTH

WHEREAS, the City of Miami has participated in employ-
ment and training programs under the Comprehensive Employment
and Training Act of 1973; and
WHEREAS, the Act encourages and provides financial incen-
tive for entering into Consortium or intergovernmental agreements
where appropriate to service a labor market area; and
WHEREAS, the governments of Dade and Monroe Counties,, and
the Cities of Miami, Hialeah and Miami Beach are currently being
served on an area -wide basis through an inter -local agreement
authorized by Resolution No 74-111, adopted on February 4, 1974;
and
WHEREAS, the U.S. Department of Labor has mandated ce
changes in the structure of the former Consortium Board necessi-

WHEREAS, - the governments , of Dade and�Tr�oArbl��CA�t3•�
the Cities of Miami, Hialeah and Miami Beach wish to continue
this Consortium approach to planning and implementing employment,
training and related programs under the Act.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF MIAMI,
FLORIDA:

In February, 1974, the City of Miami entered into an agreement
with the Cities of Hialeah and Miami $each, and the Counties of
Dade and Monroe to form the Manpower Planning Council and
Consortium: Subsequently, the Manpower Planning Consortium
became the South Florida CETA Consortium, other than the name
change, the Agreement of 1974 retrained in effect until the de-
velopment of the attached,
For Comparison purposes, the old Agreement provided that:
1) The County Manager was authorized to act for
and on behalf of the Consortium; and
The County Manager was authorized to administer
the affairs of the Consortium; and
3) The County Manager was authorized to appoint
the Executive Director and appropriate staff
personnel; to expend funds for both planning
and administrative purposes; and
The Metropolitan Dade County Government, as.
delegate agent for the Consortium, shall:
a) Prepare the annual plan for CETA programs
and projects;
b) Prepare the annual budget for CETA;
c) :Maintain the financial accounting system
for CETA.
The new Agreement provides that:
1) The Consortium acts on its own behalf and

The Consortium appoints an EReoutive birectbr

4) The Consortium staff shall:
a) Prepare the annual plan;
b) Prepare the annual budget;
c) Maintaina financial accounting system;
d) Monitor, evaluate, audit and provide technical
assistance to those requiring same; and
The Consortium staff shall prepare appropriate
reports for elected officials of each member
jurisdiction as required by the Consortium.
Effectively, then, the new Agreement causes members of the con-
sortium to become directly responsible for activities previously
contracted with Dade County and its Manager. Further, the new
Agreement specifies that the representatives to the Consortium
shall be either an elected official or the chief non -elected
official of local government; and said representative shall be
designated by their respective legislative bodies.
Consequently, it is appropriate for the City of Miami Commission
to adopt the attached resolution authorizing the City Manager to
enter into the Agreement with the South. Florida Employment and
Training Consortium; and, further, to approve, authorize and
appoint the City Manager to serve as the representative of the
City of Miami to said Consortium.

WHEREAS, it is desirable to conduct programs on an areawide basis

roviding for emplo?ment and training opportunities for the economically
disadvantaged, unemployed and undereTT loyed and to assure that training
and other services are organized and delivered in the most effective
and efficient manner; and
WHEEEAS, Metropolitan Dade County, the. City of Miami, the City
of Hialeah, the City of Miami Beach, and Monroe County, are located
in reasonable proximity to each other, and
WHEREAS, Metropolitan Dade County, City of Miami, and City of
Hialeah each has a population of 100,000 or more; and.
1HEREAS-, all of Dade and Monroe: Counties can be effectively served

WHEREAS, the Florida thterlocal Cooperation Aet of 1969 Section
163.01 et seq., Florida Statutes 1977 and Metropolitan bade County
Horne Rule Chatter provide a method for governfental entities to join
inorder to perform programs of the type intended;
NOW, THERE :OFF, in consideration of the convenants, conditions
and premises herein set forth, the parti Ps arree as follows
1. That the parties hereto do all mutually and individually
agree to form with each other an entity known as the South Florida
Employment and Training Consortium.
That the purpose of this Consortium is to conduct rrDFa'ns

3. That this agreement shall be approved by the affirmative
vote of the legislative body of each jurisdiction (i.e. the City
Commission of the City of Miami, the City Council of the City of
Hialeah, the City Commission of Miami Beach, the Board of County
Commissioners of Dade and Monroe Counties), and upon approval, shall
supplant the existing agreement executed in 1974.
4. That the representatives to the Consortiumfrom each
member local government shall be either an elected official or the
chief non-elected/appointed official of local government. Said
representative shall be designated by their respective legislative
bodies.
That the Con ortium hereby formed shall have the
power to:
a. Receive all grants, funds, allocations, and any and
all forms of revenue based on, or pursuant to the Act, to receive
gifts, or other resources from any agency or agencies of the
grants
United States Government, and/or the State of Florida or other sources,

b. To enter into contracts or agreements with any
corporation municipality, or any other legal entity, public cr privates'
or any other person or persons for the performance of such services as
may be required by the terms of any grant, contract, or agreement
entered into, or with, any agency or agencies of the government of the
State of Florida and/or the United States, or any other organization.
c, To, by four (4) affirmative votes of its members,
promulgate such policies and by-laws, and to amend such policies and
bylawsas necessary for the conduct of its business.
d. To expend funds for both planning and administrative
purposes as deemed necessary and appropriate.
e, To plan, implement, coordinate, review and evaluate
programs; and to fund, monitor and audit projects which have been
approved by the Consortium.

g. To appoint and remove an Executive Director who
shall serve at the will of the majority of the Consortium. Said

of the South Florida Employment and Training Consortium. The staff
will be hired pursuant to an appropriate merit system,

7, That the South Florida Employment and Training Consortium
staff shall perform the following and other duties as delegated by the
Consortium;
a. To prepare an annual plan for programs and projects
within the Dade and trionroe Counties area which shall be based upon
the followings
1) Community input as to manpower training and
employment needs within the area,
2) Statistical analysis of manpower training and
employment needs within the area.
3) A current resource assessment, consisting of
a statement of resources available to the parties hereto for the
implementation of manpower programming, and a statement of the
in which these resources are being or are to be allocated.
4) An assessment of priorities within the
area, and
5) A statement of manpower training and employment

eeds and the extent to which they will be met within the year to which
annual plan will refer. The annual --plan herein provided

8, That the ConsortiuM shall cause to be created a ManpoWer
Planning Council in accord with the Act,

That the Counties of Dade and Monroe and any municipality
Within same, now or hereafter, with a population of fifty thousand
(50,000) may be permitted to become parties to this agreement with
the unanimous consent of the parties hereto.
10, That this agreement may be amended from time to time
upon the affirmative vote of eac1'legislative body, (i.e,, the City
Commission of the City of Miami, the City Council of the City of
Hialeah, the City Commission of the City of Miami Beach, the Board
of County Commissioners of Dade and :'.onroe Counties), of the parties
hereto.
11. That any party hereto shall have the right to withdraw
from this agreement at any time upon the following conditions:
a. That the Consortium by and through its executive
director shall have received written notice of the party's intent to
withdraw not later than ninety (90) days before the end of the then
current federal fiscal year.
b. That the party
shall not be released from any-finan.cia'
or any other obligations incurred by that party during the then
or prior fiscal years.
12, Ant majority of the Consortium shall constitute a quorum,
but no'action of the Consortium shall be valid' or binding:unless
adopted at a public meeting by at least three (3) affirmative votes
unless otherwise provided in this afreement,
