AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MIAMI, BY CHANGING THE ZONING CLASSIFICATION OF LOT 13 LESS THE WEST 10 FEET, AND LOTS 14, 15, 16, 17, 18, AND 19 LESS THE EAST 25 FEET, LESS THE SOUTH 15 FEET OF LOTS 13 THROUGH 19 INCLUSIVE, BLOCK 9, RAILWAY SHOPS ADDITION 2ND AMD (3-183), BEING THE NORTHEAST CORNER OF N.W. 53RD STREET AND 7TH AVENUE, FROM C-1 (LOCAL COMMERCIAL) TO C-4 (GENERAL COMMERCIAL), AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE NO. 6871 BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY PROVISION. r L/i WHEREAS, the Miami Zoning Board, at its meeting of November 6, 1978, Item No. 5, following an advertised hearing, adopted Resolution No. ZB 194-78 by a 6 to 1 vote recommending denial of change of zoning classification as hereinafter set forth; "DOCUMENT 1 DEX I WHEREAS, notwithstanding the recoTEMnime 4A ation�of ile and Zoning Board, the Commission, after careful consideration and due deliberation of this matter deems it advisable in the best interest of the general welfare of the City of Miami and its inhabitants to grant a change in zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami be, and the same is hereby amended by changing the zoning classification of Lot 13 less the west 10 feet and Lots 14, 15, 16, 17, 18, and 19 less the east 25 feet, less the south 15 feet of Lots 13 through 19 inclusive, Block 9, RAILWAY SHOPS ADDITION 2ND AMD (3-183), being the northeast corner of N.W. 53rd Street and 7th Avenue, from C-1 (Local Commercial) to C-4 (General Commercial), and by making the necessary changes in the zoning district map made a part of said Ordinance No. 6871 by reference and description in Article III, Section 2 thereof. Section 2. That all laws or parts of laws in conflict herewith be, and the same are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole. Applicant is seeking to consolidate their piece of land under the same zoning classification for future development. APPROVAL: The proposed rezoning from C-1 to C-4 is consistent with the Comprehensive Neighborhood Plan. The rezoning will not be harmful to the neighborhood since the site is encompassed by commercial districts. Although the City already has a plethora of land zoned for "heavy" commercial uses, this site's proximity to the North -South Expressway and to N.W. 54th Street, which is a major arterial, does not encourage its development with neighborhood commercial uses. This is exhibited by the fact that this site has remained unoccupied for several years. By rezoning to C-4, this site can be consolidated and developed jointly with the C-4 property on N.W. 54th Street. Recommended Denial, November 6, 1978 by a 6-1 vote. APPROVED on 1st reading, December 14, 1978. DEFERRED. January 18, 1979.
