BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is authorized to execute the attached Agreement with the General Services Administration of the United States Government, in accordance with the terms and conditions set forth therein. FEB 13 1979 FILE: SUBJECT: Memorandum of Understanding with GSA REFERENCES: ENCLOSURES: Several months ago, we were contacted by the General Services Administration, Region IV, located in Atlanta, Georgia, with a proposal that the City enter into the attached memorandum of understanding, which would be mutually advantageous to both the Federal Government and the City. As part of President Carter's Urban Policy, he directed GSA to attempt to involve central cities in their decisions concerning location of the Federal offices, to make available surplus government owned real and personal property to cities as feasible, to work with cities in assuring that areas which have been designated as labor surplus areas would be assisted in applying for various Federal contracts with particular emphasis on the involvement of minority contractors in various Federal purchases. As part of GSA's endeavor to implement the President's Policy, they are offering to: 1. Coordinate their locating of Federal agencies with the City's objectives of core area revitalization 2. Coordinate and make available various Federal facilities by City or non-profit organizations 3. Make government surplus property and GSA's purchasing abilities available to the City 4. Assist in establishing procedures for minority contractors to be involved in GSA procurement In response, the City agrees to keep GSA informed of development plans in the City, and to assist GSA in disposing of any surplus real property that it may have available. It is my recommendation that the City enter into this memorandum of understanding with GSA, and that this be placed on the City Commission's agenda for February 22, 1979. "SUPPORTIVE DOCUMENTS FOLLOW" 79-123 MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is entered into by the General Services Administration of the United States of America (hereafter "GSA") , and the City of , (hereafter the "City") . It is the policy of the United States of America to improve the effectiveness of existing Federal programs which have an impact on the cities; reorient resources in order to make Federal actions more supportive of distressed areas; and change policies that have worked against the cities. Whereas, the Administrator of GSA has been directed, by the President of the United States, to implement these policies in the programs for which he is responsible; and, Whereas, the City wishes to avail itself of benefits accruing to cities affected by these policies; Now, therefore, GSA and the City enter into the following understanding: I. PURPOSE. It is the purpose of this memorandum to provide for cooperation between GSA and the City to ensure implementation of the urban policies of the United States and to permit the City to take full advantage of certain urban programs. II. FINANCIAL ARRANGEMENTS . It is agreed that the carrying out of the provisions of this memorandum shall not impose any costs upon the City, or involve the expenditure of funds by the City for any reason, other than (1) those costs associated with the provision of information required hereunder, which information shall be provided as a part of the routine administrative functions of the City; or (2) those costs associated with the provision of technical information developed by GSA and provided to the City upon request on a reimbursable basis . GSA shall incur no costs under this memorandum other than those associated with the performance of its missions and responsibilities. III. ADMINISTRATION. This memorandum shall be administered by the Regional Administrator of GSA and the of the City. IV . UNDERSTANDING OF THE PARTIES. A. In accordance with the urban policy of the United States, GSA agrees to consult and cooperate with the City on major Federal activities in its jurisdiction for which GSA is responsible. These activities shall include but not be limited to: 1, r 1 L) ('1 tah / r, �'Y 79-123 (1) locating or relocating Federal agencies in the City's central business area and adjacent areas of similar character whenever this is consistent with the agencies' missions; (2) coordinating projects to allow city officials maximum input into the space planning process, particularly with reference to land use planning, environmental concerns, and consistency with local development plans; (3) giving preference to buildings of historical, architectural, or cultural significance in meeting Federal space needs where feasible and prudent; (4) encouraging and facilitating the use of Federal facilities by cultural, educational, and retail/ commercial groups within the community. B. In addition, GSA shall endeavor to: • (1) notify the City of available surplus Government -owned real and related personal property which is located in the City's jurisdiction, furnish the City information on how the property may be acquired, and provide the City assistance in rezoning such property to facilitate its disposal and reuse; (2) afford the City the opportunity to zone the property referenced above in accordance with local planning objectives and notify any prospective purchasers of current or planned zoning regulations for such property; (3) advise the City of the method of obtaining Federal surplus personal property which is made available for donation to the states for public purposes; (4) make available to the City on a reimbursable basis technical information developed by GSA which may be of use to the City in performing its governmental functions; and (5) advise the City of Federal procurement requirements for which business concerns in the City may be eligible to bid, including those under the Labor Surplus Area program, and assist concerns in applying for such Federal contracts. C. The City agrees to: (1) keep GSA informed of short and long range plans for development in the City with particular regard to identifying areas appropriate for the location of Federal facilities and activities; (2) support the efforts of GSA in locating Federal facilities and activities in the central business area of the City; -2- III IuIIIII.IIIIIIIIIIIIII III (3) provide GSA with the names of contractors eligible for GSA's Labor Surplus Area Program; and (4) support GSA in disposing of surplus real property by providing expedi- tious handling of zoning matters relating to the use of the property after it leaves Federal ownership. V. APPLICABILITY OF OTHER LAWS , EXECUTIVE ORDERS, AND REGULATIONS. This Memorandum of Understanding shall be subject to all applicable laws, Executive Orders , and regulations of the United States in existence at the time of any actions taken hereunder.
