HomeMy WebLinkAboutR-79-0122(1i 1/19/79 nsm RESOLUTION NO. 7 9- 1 2 2 A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE IN LIEU OF CONDEMNATION, A VACANT PARCEL OF LAND COMPRISED OF A LAND AREA OF 5,251.5 SQ. FT., M/L, LYING IMMEDIATELY WEST OF 2431 S. W. 4th STREET, MIAMI, FLORIDA, FOR THE SUM OF TWENTY-THREE THOUSAND ($23,000.00) DOLIARS, AND ALLOCATING TWENTY-THREE THOUSAND FIVE HUNDRED, ($23,500.00) DOLLARS FROM FIRE FIGHTING, FIRE PREVENTION & RESCUE FACILITY BOND FUNDS TO COVER THE COST OF ACQUIRING FEE SIMPLE TITLE TO THIS PROPERTY AND OTHER COSTS INCIDENTAL TO THE ACQUISITION. WHEREAS, the property located immediately west of 2431 S. W. Fourth Street, proposed to be acquired for Fire Station #14; and WHEREAS, the Fire Department has approved the acquisition of this property to provide for Fire Station No. 14, and concurs with this recommendation to acquire this parcel; and WHEREAS, funds from Fire Fighting, Fire Prevention & Rescue Facilit Bonds, as identified in Paragraph B, Subparagraph 4 of the General Obligation Bond Appropriation Ordinance #8716 are available to acquire said parcel; and WHEREAS, the owner of the property has, by Agreement dated the 8th of January, 1979, offered to convey simple title to this property to the City of Miami, Florida for the negotiated price of Twenty -Three Thousand ($23,000.00) Dollars; and WHEREAS, it is deemed in the best interests of the City of Miami, Florida to acquire the property at this time through purchase in„1QM C NT ,I 0 y condemnation; ITEM NO NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager be and he is hereby authorized and directed to purchase the property located immediately West of 2431 S. W. 4 Street, Miami, Florida, legally described as: Lot 181, Beacom Manor, PB 8-121 for the development of Fire Station No. 14, for the sum of Twenty -Three Thousand CITY COMMISSION MEETING OF ,aoeimn+ M0.7 9 - 1 _2 +wit ........................... rr ($23,000.00) Dollars. Section 2. That Twenty -Three Thousand Five Hundred ($23,500.00) be and it is hereby allocated from the Fire Fighting, Fire Prevention & Rescue Facility Bonds, as identified by Paragraph B, Subparagraph 4 of the General Obligation Bond Appropriation Bond Ordinance #8716, to cover the cost of acquisition of fee simple title to this property, and other costs incidental to this acquisition. Therefore, it is recommended that this property be acquired for the negotiated price of $23,000.00 as directed by the Department of Fire by Memorandum dated November 29, 1978, a copy of which is attached. Chief H. W. Brice, Director of Department of Fire, recommended acquisition of this parcel for the above - mentioned price. Brice, Director Department of Fire, authorization was received to acquire property for the construction of the proposed Fire Station #14. This acquisition will consist of acquiring a vacant piece of land. The pertinent facts of this acquisition are as follows: - Appraiser: Delahanty & Associates, Inc. - Appraised Value of Property: - Property Location - Legal Description Fee: $750.00 $16,500.00 2431 S. W. 4 Street Lot 181, Beacom Manor, PB 8-121 - Owner Mr. & Mrs. Norberto Hernandez - Lot Size 5,251.5 Sq. Ft. M/L - Improvements None The negotiated price to purchase this parcel at $23,000.00 is predicated on the following reasons: That this is a take of the side yard and not a total acquisition, therefore, depriving the owner of the use of open space. That to condemn rather than acquire by negotiation could be more costly due to attorney's fees and court costs. That there would be an interminable delay in the process to acquire and that a contract has been entered into with the architectectural firm of Taquechel & Associates, Inc. to design a Fire Station for this site. It is agreed by the members of the acquisition negotiating committee, which is composed of the Property Manager, and members of the Fire Department, that in order to acquire 79-122
