RESOLUTION NO. 79-192
A RESOLUTION WAIVING THE REQUIREMENTS OF
ARTICLE V, SECTION 2-102 (CONFLICT OF
INTEREST) OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, BY FINDING THAT IT IS
IN THE BEST INTEREST OF THE CITY TO PERMIT
BERNARD L. ROBERTS, AN EMPLOYEE OF THE
PARKS DEPARTMENT, TO PARTICIPATE IN THE
CITY'S REHABILITATION LOAN PROGRAM ADMINIS-
TERED BY METROPOLITAN DADE COUNTY.
WHEREAS, the City, through the U. S. Department of
Housing and Urban development has embarked upon a home
renovation and rehabilitation program for its residents; and
WHEREAS, Metropolitan Dade County has been engaged to
administer said program; and
WHEREAS, BERNARD L. ROBERTS, a City of Miami Parks
Department employee, who resides within the City, has applied
for a rehabilitation loan under this program; and
WHEREAS, said employee qualifies in all respects for
participation in said program except that he is employed by
the City of Miami and would be in technical violation of
Article V, Section
article; and
WHEREAS, a waiver must be obtainedT M NP1LD L.

ROBERTS' participation in said program; and
WHEREAS, the City can only avail itself of the oppor-
tunity to participate in a valid housing redevelopment
program through offering the program to all residents of the
City, notwithstanding their employment by the City of Miami;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF MIAMI,
FLORIDA:
Section 1. The requirements of Article V, Section 2-
102 of the Code of the City of Miami, FLorida, as amended,
with respect to the transaction of BERNARD L. ROBERTS with
CITY COMMISSION

REMARKS: ,
the City's rehabilitation loan program, administered by
Metropolitan Dade County, is hereby waived, with respect to
any possible conflict of interest.

Enclosed for City Commission review and approval is a resolution
waiving the requirements of Article V, Section 2-102 of the Code
of the City of Miami in the case of Bernard L. Roberts, an employee
of the City's Parks Department. Mr. Roberts has applied for a
Rehabilitation Loan and has been found eligible under the City's
Great Neighborhoods program requirements. We have been advised by
the Law Department, however, that Article V, Section 2-102 states
that no City employee shall enter into any contract or transact
any business with the City. As a result, Mr. Roberts cannot partici-
pate in the City's Great Neighborhoods Rehabilitation Loan program.
We do not believe that Mr. Roberts should be penalized because he
works for the City of Miami in this instance, and hereby recommend
that Article V, Section 2-102 of the Code by waived so that he can
participate in the program.
