RESOLUTION NO. 79-158
A RESOLUTION FINDING AND DETERMINING THE PUBLIC NEED
AND NECESSITY FOR ACQUIRING THE FEE SIMPLE TITLE TO
CERTAIN PROPERTY DESCRIBED HEREIN TO BE USED FOR THE
CONSTRUCTION OF THE CONFERENCE CONVENTION CENTER GARAGE;
AND DIRECTING THE CITY LAW DEPARTMENT TO INSTITUTE AND
PROSECUTE TO A CONCLUSION ALL OF THE NECESSARY LEGAL
ACTIONS TO ACQUIRE THE FEE SIMPLE TITLE TO THIS PROPERTY
AS SOON AS IT IS LEGALLY POSSIBLE, INCLUDING THE FILING
OF A DECLARATION OF TAKING.
WHEREAS, the City of Miami is empowered by its Charter to
acquire in fee simple by condemnation or otherwise property real or
personal, or any estate or interest therein, for any of the purposes
of the City; and
WHEREAS, the City Commission finds that the acquisition of the
fee simple title is and to property described in Section 1 is necessary
for the construction of the Conference Convention Center Garage; and
WHEREAS, the City Property Manager has been unable to reach a
purchase agreement for subject property; and
WHEREAS, the City Commission finds that as soon as the subject
property is acquired the City will be ready to begin construction f
the Conference Covention Center Garage;If

WHEREAS, it is necessary that appropriat s ep's t acquire the
property described in Section 1 be taken so that said property may be
made ready to accommodate thepublic need for the additional facility;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. It is hereby determined and found necessary for a
public purpose in order to provide for the construction of the
Conference Convention Center Garage that the following property be
acquired in fee simple by gift, purchase, or condemnation, to wit:

Section 2. That the City of Miami, Florida, its agents and
employees are hereby directed to acquire by gift, purchase or
condemnation, the fee simple title in and to the property described in
Section 1 above as soon as it is legally possible, including the filing
of a declaration of taking and utilization of any and all statutes of the
State of Florida applicable thereto.
Section 3. The City of Miami, its employees and agents are
authorized and directed to incur all the necessary expenses to
institute and maintain said condemnation proceedings.

The City Commission, by Motion No. 78-725 authorized the
City Manager to determine if the two out -parcels are
needed for the construction of the Conference/Convention
Center Parking Garage. Attached herewith are copies of
the pages, with the recommendation underlined, from the
"Feasibility Report for the Proposed Conference/Convention
Center Garage" prepared by Conrad Associates East, the
parking consultant to the Off -Street Parking Authority.
In addition, Motion Mo.78-725 directed the City Manager
to start condemnation proceedings on the two parcels.
Discussions have been held with the owners of both proper-
ties and may lead to a successful negotiated sale of one
or both parcels. If the purchases can be negotiated, then
the City will, of course, withdraw the condemnation
proceeding.
Arrangements are being made by the Planning Department for
relocation of the Butler Building, possibly to Lummus Park.

Included with this letter is the feasibility report on the Proposed
Parking Garage No. 5, to serve the City of Miami/University of
Miami Jaynes L. Knight Intern.ational Center.
The report recommends development of the Proposed Parking Garage
No. S. We believe it is desirable. to uurchase the additional parcel
of to make the site nearly square. The parking capacity of the
rec_ornrnended facility would be 749 si)ac:es or 928 spaces, depending
on whether the City of Miami decides to mek.e provision for an air -
rights structure above the Garage. The capital cost of $6,870,000
or $10,400,000 would be met by the issuance of revenue bonds. Any
parking revenue bond issue sold by the Department of Off -Street Park-
ing would have to be guarr.tnced by the City of Miami for the first
five (or more) years, as the required amount can not be funded under
the existing Bond Ordinance.

SUMMARY OF HF:PORT
•,This report cxamines the feasibility of a parking garage to serve
the City of Miarni/University of Miami James L. Knight International
Center. The consideration of two major alternatives results in the
study of six schemes. The two major alternatives are•
o Purchase_ of additional land parcel.
o Provision for air rights structure above the garage.
The principal recommendations of the report are:
o Construct a garage with a capacity of 749 spaces without air
• rights provisions or 938 spaces with air rights provisions.
• Purchase additional parcel ofland,�
• Carefully consider the inclusion of the air rights provisions.
• Finance the project through separate bond issues for the City of
Miami portion and the Department of Off -Street Parking portion;
OR
Finance the project through a single bond issue sold by the
Department with the City paying the' Department at an accel-
erated rate to amortize the City portion of the project in thirteen
years instead of thirty years.

the time to achieve a break -even condition for the new garage.
Should it be possible to acquire the additional land necessary
for these schemes, then schemes C--1 or C-2 are recommended.

2. It is recommended that the additional parcel of land be acquired
by the City of Miami for use as part of this project. This addi-
tional land is necessary to con,,trerct a parking g,-iraye of the
size required to properly serve the convention center complex.
Also, as determined by r rendino, Crofton, Spillis, Candela, this
additional land is needed if a feasible air rights structure is to
be included in the project.
One lot of the additional parcel of land has a building upon it
which may be considered a "historical building" within the city.
Should this building receive the "historical" classification, con-
siceration might be given to relocating the building to another
site so that this -site can be used for the proposed project. For
" example, the "hisotircal building" might be relocated to a site
along the proposed river walk under the expressway in the vicinity
of S.W. North River Drive and S.W. 3rd Street. The Department
