WEIREAS, the City Commission adopted Ordinance No. 8858 on
September 28, 1978, establishing revenues and appropriations for the
City of Miami, Florida, for the fiscal year endi tg September 30, 1979
and
WHEREAS, Ordinance No. 8890, adopted January 18, 1979; estab-
lished a new Trust and Agency fund entitled: "Social Service Programs -
Fiscal Year 1978-79," and appropriated thereto an amount $552,180 for
the operation of specific social service programs; and
WHEREAS, additional funds in the amount of $7,086 are needed to
provide funding for a Puerto Rican Opportunity Center employee
position formerly funded by CETA; and
WHEREAS, an amount of $7,086 is available in the Federal Revenue
Sharing Fund Balance for FY'77-78 and can be appropriated into Special
Programs and Accounts for FY'78-79 Social Service Programs for trans-
fer to the aforementioned Trust and Agency Fund;
NOW. THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF

WHrREAS, the City Commission adopted Ordinance No. 8858 on
September 28, 1978, establishing revenues and appropriations for the
City of Miami, Florida, for the fiscal year ending September 80, 1979
and
WHEREAS, Ordinance No. 8890, adopted January 18, 1979, estab-

The attached ordinance amends section 1 and 6 of ordinance #8858 which establishes
revenues and apnronriations for the City of Miami for the fiscal year ending
September 30, 1070.
This ordinance ref1 r.ts a :%7,086.00 increase in Federal Revenue Sharing Funds
allocated to the Puerto 7ican Opportunity Center in order that Mr. Jose Mendez
can receive the same benefits as a CETA VI Sustaining Participant.
This salary changeis required because Mr. Mendez was found ineligible by the
South Florida Employment and Training Consortium Staff due to the fact that he
was paid from Federal Revenue Sharing Funds three weeks prior to his enrollment
and during the intake process for enrollment.'
This payment was not due to deception or any illegality on the part of the City
of Miami or Mr. Mendez and it is justifiable his position be continued by the
funding change created by this ordinance.
The services Mr. Mendez provides for this Agency have been deemed critical to
the overall operation of this program's activities.

Dear Mr. Lopez:
This correspondence constitutes administrative authority to absorb Mr. Jose
Roman Mendez's position through the City provided Federal Revenue Sharing
,tontract with Puerto Rican Opportunity Program in order that Mr. Mendez might
,•enjoy, generally, .the same benefits that he enjoyed as a CETA VI Sustaining
1 participant. The effective date of this Contract amendment shall be February 12,
1979.
As you know, the South Florida Employment and Training Consortium staff has
ruled that Mr. Mendez is no longer eligible as a CETA participant because
for three weeks prior to his enrollment as a CETA participant and during the
intake process for enrollment, he was paid on an interim basis with Federal
Revenue Sharing Funds, which again, according to the SFETC staff, constitutes
a violation of maintenance of efforts requirements on the part of the City.
Owing to the fact that no deception or any illegalities were conspired and
owing to the fact that the City of Miami's understanding was, in fact, that
payment of Federal Revenue Sharing Monies did not constitute a violation of
maintenance of efforts, it is only reasonable and just that Mr. Mendez be pro-
tected in the manner that I have outlined above.
I shall insure that this subject is brought before the City of Miami's Commission
at its first meeting in March requesting their approval of this administrative
action.
