Grassie City Manager 3500 Pan American Dr. Miami, Fia. 33133 Dear As a Group of concerned citizens trying to halt development along the Miami bayshore, the B.A.I. committee is obliged to call to the City Co^Imission's attention a recent bayshore development that not only is the nroduct of misrepresentation to concerned individuals like ourselves, but is now unaccountable to and un- addressed by the public because of its improper inclusion in a commission -approved project. When the City Commission approved Resolution No. 77-160 on Feb. 24, 1977, the plans on which bids were called contained the removal of parking snaces and certain street widenings and direction changes that were not called for in City Resolution No. 76-995, which originally created the Main Highway Improvement District. In addition, the plans neglected to specify the removal of the existing sodium vapor lights implicit in the resolution. Specifically, the original resolution called only for the improvements of old fashioned street lighting, brick sidewalks and planters, curb and gutter, drainage, and a decorative pedes- trian crosswalk on Fuller Street. It is the opinion of this com- mittee that traffic lane changes and narking reduction .do not fall in any of the broad categories listed above, and that removal of existing lighting not only falls into the first category but is directly implied by it. The Department of Public Works claims a right to neglect the latter nro.ject and nroceed with the former because of its constant consultation with a "blue ribbon committee" and, in the plants final drawing stares, a week long invitation for property owners in the area to inspect the plans. Not only is this io direct conflict with established legal princinles, but we feel it is yet another example of city's denial to interested and affected individuals and groups of due process of pu`,lic works procedures; replacing it instead with the opinions of developers and land owners. Because of the improper development of these plans and their present unaccountability to the public, we urge the City Commission to resolve to authorize the City Manager to strike the parking and traffic lane changes from the construction contract and take steps to remove the existing street lighting on Main Highway.
