A RESOLUTION OF THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA, RECOMMENDING TO THE LEGISLATURE
OF THE STATE OF FLORIDA THAT NO CHANGES BE
ADOPTED IN THE LEGISLATION PERTAINING TO
CHAPTER 175, FLORIDA STATUTES, ENTITLED
"MUNICIPAL FIREMEN'S PENSION TRUST FUND"
OR TO CHAPTER 185, FLORIDA STATUTES, ENTITLED
"MUNICIPAL POLICE OFFICER'S RETIREMENT TRUST
FUND; POLICEMEN GENERALLY", AND DIRECTING THE
CITY CLERK TO FORWARD A COPY OF THE HEREIN
RESOLUTION TO PROPER STATE OFFICIALS.
WHEREAS, the City of Miami, Florida, through Ordinance
No. 6432. adopted on September 2, 1959, has duly maintained the
"Municipal Firemen's Pension Trust Fund" as provided under present
Chapter 175, Florida Statutes, following litigation in the Circuit
Court of Dade County, Florida (City of Miami v. G. H. Carter); and
WHEREAS, the City of Miami, Florida, through Ordinance
No. 6558, adopted on February 3. 1960, has duly maintained the
"Municipal Police Officer's Retirement Trust Fund" as provided
under present Chapter 185, Florida Statutes, following litigation
in the Circuit Court of Dade County, Florida (City of Miami v.
Leon Hall); and
WHEREAS, both Funds have been administered under the
above ordinances pursuant to approval by the Circuit Court of Dade
County, Florida, and the participants in the Funds now have vested
rights in the same; and
WHEREAS, the alteration or modification of the Funds
may seriously hamper or adversely affect the administratl� Q,f

WHEREAS, the City Commission is unalterably opposed
to any changes in the provisions of Chapters 175 or 185 Florida
Statutes concerning the said Funds:

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. The Commission of the City of Miami hereby
recommends to the legislature that no changes be adopted in either
Chapter 175, Florida Statutes, entitled "Municipal Firemen's Pension
Trust Fund" or to Chapter 185, Florida Statutes, entitled "Municipal
Police Officer's Retirement Trust Fund; Policemen Generally", that
would in any way amend or repeal the pension position of the City
of Miami, or affect the participants in the Miami Firemen's Relief
and Pension Fund operated pursuant to Ordinance No. 6432, adopted
on the second day of September, 1959, or in the Miami Police Relief
and Pension Fund operated pursuant to Ordinance No. 6558 adopted
on the third day of February, 1960.
Section 2. The City Clerk is hereby directed to
forward copies of this Resolution to the legislative delegation
of Dade County, Florida, and the President of the Senate and the
Speaker of the House of the State of Florida.
