t,JHEZEAS, Florida Statute 3S.06 requires a local Government
to give notice and hold a public hearing on an application for
development approval of a development of regional impact prior
to issuing a development order; and
WWTHEPFAS, the South Florida Regional Planning Council has
forwarded a letter to the City of Miami_ stating that the Ballpoint
application for development approval contain sufficient informa-
tion for their review; and
tqIEREAS, Florida Statute 30.06 requires the local Government
to set a public hearing at its next scheduled meeting after the
receipt of said letter;
NOW, THEREFORE, BE IT RESOLVED BY THE CO*MISSION OF THE

It is requested that the Commission
establish May 24, 1979 as the date
of the Development of Regional Impact
public hearing for Ball Point, per
the attached Resolution.
Per Chapter 380.06 F.S. local government is required to give notice
and hold a public hearing on an Application for Development Approval
of a Development of Regional Impact prior to issuing a development
order.
By letter of March 16, 1979, (attached) the South Florida Regional
Planning Council stated that the Ball Point Application for Develop-
ment Approval contained sufficient information for their review and
would be scheduled on their agenda May 7, 1979. Further, the letter
stated that the Development of Regional Impact public hearing must
be set at the next scheduled meeting of the Commission and advertised
at least 60 days in advance of the hearing, per Chapter 380.06 F.S.
It is requested that the Commission consider the setting of the
hearing date at their meeting of March 22, 1979 and establish May
24, 1979 as the Development of Regional Impact public hearing date
for the Ball Point project, which would allow for the required 60
days notice.

Dear Mayor Ferre:
This letter is to give written notice that the Ball Point Application
for Development Approval contains sufficient information for regional
impact review.
A Development of Regional Impact public hearing as required by Chapter
380.06 (7), Florida Statutes amended must be set at your next scheduled
meeting and advertised at least sixty (60) days in advance of the hear-
ing. The law also requires that the notice of public hearing be trans-
mitted to the Division of State Planning and the South Florida Regional
Planning Council. Receipt of this notice will officially commence our
fifty day review period. At this time, the South Florida Regional
Planning Council staff report and recommendations are tentatively
scheduled to be presented for official action at the regular Council
meeting on May 7, 1979.

Per Resolution 79-239 dated March 22, 1979, the Miami City Commission set May
24, 1979 as the date for the public hearing for Ball Point, a Development of
Regional Impact (see attached advertisement). Scheduling of the public hearing
has been approved by the South Florida Regional Planning Council by letter of
March 16, 1979. By copy of this letter, the South Florida Regional Planning
Council and other interested parties have also been informed.
