Voluntary relocation of tenants of
either Pier 4 or Pier 5 at
Dinner Key Marina for Summer Boat
Show (Victor Logan).

On :larch 22, 1979, the City Commission passed Motion 79-229
as follows:
"A motion instructing the City Manager to begin negotiations
with the tenants of either Fier or Fier 5 to request their
voluntary removal cf vessels fret: said piers in order to
acccr.:'.cdate Victor Loran's Summer Boat Show, providing that
in the event of failure in such negotiations, the City Manager
be instructed to investigate other alternatives."

to each t-nent cf Piers 4 and 5 in implementation of the City

In view cf the failure of the City's attempt to achievevoluntary
relocation of the tenants of either Pier 4 or Pier 5, it now
appears that there are two options available to the City, as
follows:

1. Take no action and let Mr. Logan either:
a. Present his boat show without an in -the -water
display, or
b. 7.ake individual. arrangements with each tenant
to pay him to vacate. This would undoubtedly
be an expensive solution for Mr. Logan,
but his sale price of Ten cellars ( 1O)
per lineal foot for display space on the pier
for the term of the show (as opposed tc the City's
rental rate of Ter: cents (.10) per foot per day)
might make this a feasible solution.
2. Exercise the unqualified provision in the Dockage Agreement
of each tenant which says, "This ;reement shall be termi-
nated upon one of the following conditions:
(a)
(b) By written notice of termination by the City.

Then, after termination of the Dockage Contracts of all
tenants on either Pier 14 or Fier 5, immediately issue
them new Dockage Contracts requirir.-* them tc move for

Clearly, this approach could, and probably would, lead to
legal action by at least some of the tenants. The City
At.:orney has advised this Department that he feels our
