RESOLUTION NO. 7 9 2 7 E
A RESOLUTION AUTHORIZING PAYMENT OF
$73,815 TO BEC CONSTRUCTION CORPORATION
FOR PARTIAL PAYMENT OF THE CONSTRUCTION
CONTRACT FOR THE PROJECT ENTITLED "LITTLE
HAVANA COMMUNITY CENTER (2ND BIDDING)".
WHEREAS, the City Commission accepted the lump sum
bid of BEC Construction Corporation in the amount of $984,204
for the project entitled "LITTLE HAVANA COMMUNITY CENTER (2ND
BIDDING)" by Resolution No. 78-94, dated February 9, 1978; and
authorized expenditures of 1st, 2nd, and 3rd year Federal Com-
munity Development Block Grant Funds and the 3rd year Community
Development Contingency Fund to cover the cost of the said
contract; and authorized the City Manager to enter into a Con-
tract with said firm for the construction of the said project;
and
WHEREAS, the said contract was duly executed on
February 13, 1978, and the Contractor has completed almost 99%
of the project; and
WHEREAS, due to delays in receiving certain materials
from a manufacturer, the Contractor has not been able to finish

the project; and

WHEREAS, under the terms of the sal co the
City is retaining 10% of the contract amount, $98,420, which is
far in excess of the amount necessary to cover the cost of the
remaining work to be done; and
WHEREAS, the City Manager and the Director of the
Department of Building and Zoning Inspection recommend that the
City limit its retention to 2'2% or $24,605, in lieu of the
original 1O%--$98,420;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:

Section 1. Payment of $73,815 to BEC Construction
Corporation for partial payment of the construction contract

BIDDING)" is hereby authorized.

Background. The general contractor, BEC Construction Corporation
has completed almost 99 percent of the work under his contract.
However, due to delays in receiving certain materials from a
manufacturer he will not finish the project until mid -April. Under
the terms of his agreement, the City retains ten percent of his
earnings until final payment. In this case, that amount is $98,420.
The retainage is a considerable amount of money which is in excess
of the amount necessary to insure that the contractor completes
the work. It is also appropriate to point out that BEC has been
an excellent contractor on this project.
Resolution. In the proposed resolution the Commission will agree
to changing the contract conditions under Article 3(a) whereby
the City will retain two and one-half percent (2.5%) in lieu of
the original ten percent (10°) until all work has been performed in
a satisfactory manner and has been accepted by the City. The total
amount of the retainage will then be reduced to $24,605.
The Building Department recommends this action.
