A RESOLUTION AUTHORIZING THE CITY MANAGER
TO ACCEPT A GRANT AWARD FROM THE FINE ARTS
COUNCIL OF FLORIDA FOR ARTIST -IN -RESIDENCE
PROGRAM (5TH YEAR) AND FURTHER AUTHORIZING
THE CITY MANAGER TO EXECUTE THE NECESSARY
CONTRACT(s) AND/OR AGREEMENT(s) TO
IMPLEMENT THE PROGRAM.
WHEREAS, the City Manager or his representative
has applied for a grant from Fine Arts Council of Florida for
Artist -In -Residence Program; and
WHEREAS, this program will expand or improve the
delivery of municipal services to the residents of the City of Miami;
and
WHEREAS, sufficient City of Miami funds have been
identified to meet any requirements for match purposes;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized to accept
a grant award from the Fine Arts Council of Florida for an Artist -In -
Residence Program (5th Year).
Section 2. The City Manager is hereby authorized to execute
the necessary contract(s) and/or agreement(s) to implement this program.

The attached proposed ordinance appropriates $6,375 for an "Artist -in -
Residence Dance Program." This amount includes a grant award of $5,625 from
the Fine Arts Council of Florida and $750 from Special Programs and Accounts,
Matching Funds for Federal Grants.
The Artist -in -Residence Dance Program funds will provide six(6) hours per week
of classroom instruction under the direction of a "ballet master." Another
six (6) hours per week of classroom instruction in folk dancing will be pro-
vided by a choreographer.
This ordinance has been prepared for the April 19, 1979 City Commission
meeting.

The Fine Arts Council of Florida has offered the City of Miami a grant of $5,625
to continue our Artist -In -Residence Dance Program from January 1, 1979 through
June 30, 1979. The attached grant fact sheet provides a brief description of
the project.
Enclosed is an authorizing resolution and an appropriation ordinance for this
program. The two artists funded by this program have been conducting their dance
classes since January 1, 1979 without pay. Please have this item placed on the
April 19, 1979 Commission Agenda so that these artists can be reimbursed for their
services.

This Agreement, made and entered into this _ 1st day of January , 197.9 _, by and between:
THE FINE ARTS COUNCIL OF FLORIDA an Agency of the State of Florida within the Department of State.
Division of Cultural Affairs, hereinafter called "Council"
and
City of MiamVDept.__.Q Park_&Recreation/Crilt-ur11 Division
of the City of Miami , County of Dade , Florida. hereinafter called
"Grantee."
WHEREAS, the Council is authorized to contract. within the amounts made available by grant and appropriation
therefor, for sees ices and cooperative endeavors in furtherance of arts activities and cultural programming in the State
of Florida as outlined in its "Guide to Programs," and
WHEREAS, the Grantee is agreeable to the furnishing of such services or to engaging in such cooperative
endeavors as hereinafter set out.
NOW, THEREFORE, it is agreed between the parties hereto that the Grantee agrees to undertake the sponsorship
of a certain project entitled:

and more tally described in the Grantee's application and approved revisions thereto, if any, for a project grant for
the period specified in said application or for alternate period, as approved by the Council. Said application is
attached hereto and made a part of this AGREEMENT.
I) The Council hereby agrees to participate in the expense of this (these) event(s) to the extent of
5_.5, 625—QQ__ , to he disbursed in such increments and on such dates as the Council, in its discretion, deems
advisable. In no case shall an amount exceeding ninety percent (900:0) of this figure be provided to the Grantee until all
terms of this Agreement and applicable attachments are fulfilled. Ten percent (IOmo) of the total grant amount will be
withheld until the Grantee has submitted a satisfactory final evaluation as described in paragraph twelve (12) of this
Agreement. It is further understood and agreed that the Grantee will inform all contractors and creditors that such
contractors and creditors must look only to the Grantee for payment, and that the Grantee will in no way represent to
such contractors and creditors that the operation constitutes a joint venture with the Council or the State of Florida.
2) It is agreed and understood that the amount in Clause One (i) is the maximum contribution of the Council. Ex-
cept in mini grants and fellowships. contribution by the Council shall not exceed fifty percent (50°o) of the total cost
of the project, and up to twenty-five percent (250'o) of the Grantee's match may be declared in in -kind services.
3) The grantee agrees that funds granted pursuant to this Agreement shall he used exclusively for the purposes and
in the manner indicated in its detailed project grant application. a copy of which is contained in the Council's files in
Tallahassee, Leon County, Horida. Expenditure of grant funds is SPECIFICALLY PROHIBITED for, but not
limited to, the following purposes:
a) expenses incurred prior to grant period,
b) building, renovating. or remodeling of facilities,
c) creation of new oganizations or institutions,
d) projects which are restricted to local or exclusive participation or enjoyment,
e) capital expenditures,
f) bad debts.
g) private entertainment,
h) contingency funds,
i) investments of any. type.
4) In the event the project incurs total expenses lower than herein anticipated with the effect of making the
Council's contribution greater than fifty percent (50(r0) of the non-federal share of the total project cost, the Grantee
agrees to return to the Council an amount which will render the Council's contribution not in excees of fifty percent
(500'o) of the non-federal share of the total cost of the project cost. Any anticipated unexpended funds must be
returned to the Council no later than Juno 1, 1 979 . All grant funds must he expended by the end of the

5) it is agreed that the Grantee wilt include in all promotion, publicity, and advertising, and in the printed program
for the events) and 'or project(.$), the following credit line:
"This program sponsored by ... (name of grant recipient) ... and the State of Florida through the Fine Arts
Council of Florida, Department of State, with the assistance of the National Endowment for the Arts, A Federal
Agency. This statement shall appear in all publicity, advertising or promotional material regardless of the level of
funding support provided by the FACF. In written material, the same size type must be used for the entire credit line.
This statement must he displayed in the most appropriate and conspicuous manner.

b) FAIR LABOR STANDARDS
a) All professional performers and related or supporting professional personnel employed on projects or
productions which are financed in whole or in part under this grant will he paid, without subsequent
deduction or rebate on any account not Tess than the minimum compensation as determined by the
Secretary of Labor of the United States to he the prevailing minimum compensation for persons employed
in similar activities.

b) No part of ans 1i cct or production which is financed in wh or in part under the grant will be per-
formed or engaged in under working conditions which are unsanitary or hazardous or dangerous to the
health and safer of the employees engaged in such project or production. Compliance with the safety and
,anitary laws ot the State of Florida shall be prima facie esidence of compliance.
7) CIVIL RIGHTS -- Title VI of the Cis it Rights Act of 1964 provides that: "No person in the United States shall,
on the grounds of race, color, or national origin, be excluded from participation in. he denied the benefits of, or he
subject to discrirnrriation under any program or activity. recessing Federal financial assistance." (Section 601)
8) HANDICAPPED — Section 504 of the Rehabilitation Act of 1964 pros ides that: "No otherwise qualified
handicapped individual in the United States, as defined in Section 7(6), shall, solely by reason of his handicap, he
excluded from the participation in, be denied the benefits ot, or he subjected to discrimination under any program or
activity recers the Federal .issisrtrtce."
9) AUDIT OF RFCOR1)S -- The Fine Arts Council of Florida, the National Endowment for the Arts, an agency
of the Federal Government, and the Comptroller General of the United States, or ans. duly authorized representatives,
shall hase access to any hooks, documents, papers. and record, maintained to account for funds expended under the
terms and conditions of this grant for the purpose of making audit, examination, excerpts, and transcripts.
10) STANDARDS FOR GRANTEE FINANCIAL i1ANAGIMt,NT SYSTEMS — (grantee financial manage-
ment systems shall provide tor:

Council.
12) The Grantee agree, to pros ide the Council with such documentation as may be required by the Council and at
such time or tinges that nias her squired by the Council regarding the (grantee's status as a corporate entity or as a tax-
exempt organization as determined or defined hs the IRS code. The Grantee further agrees to immediately inform the
Council 0t .tr. ,hanee, in its status as a corporation or as a tas•exernpt organization under Sections 501(C)(3),
501(C)(4), `t?v» \) ,,iher relevant and applicable portions of the IRS code.
13) Grantee agree, to submit quarterly and final reports, supportive materials and required documentation as
detailed in the 1 ine Arts (1ouncil's "(guide to Programs," applicable portions of which are made a part hereto, to the
Council off f._es located in Tallahassee, Leon Count}, Florida, no later than the date specified on the report form.
14) The terms o' thi, agreement may. he amended with the written consent of both parties.
