A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE AN AMENDMENT TO THE ORIGINAL
AGREEMENT WITH JONATHAN G. SEYMOUR, HENDERSON-
ROSENBERG ASSOCIATES, AND DAVID M. SCULLY AND
ASSOCIATES, IN ACCORDANCE WITIH THE ATTACHED
AGREEMENT, TO PROVIDE PROFESSIONAL SERVICES
FOR THE DESIGN AND DEVELOPMENT OF TACOLCY
PARK AND 12TH AVENUE PARK BASED UPON A RE-
VISED DEVELOPMENT BUDGET OF $1,209.732 PLUS
REVISED CONSULTANT'S DESIGN FEE OF $106,414

WHEREAS, on June 13, 1977, the City of Miami entered into agreement
with Jonathan G. Seymour, Henderson -Rosenberg Associates, and David M.
Scully and Associates, for the professional and technical services re-
quired for the design and development of Tacolcy Park and 12th Avenue
Park with a project development budget of $800,000 plus a fixed fee
of $82,700 for consultant design services; and
WHEREAS, the CITY has found it proper, through

Tacolcy Board and the Model City Citizens Community Development Task
Force, to expand the scope of the Tacolcy Center portion of the project
and consequently the project development budget to $1,209,732; and
WHEREAS, the increase in the scope of the Tacolcy Center portion of
the project and the project development budget will require an increase
in the CONSULTANT'S fixed fee from $82,700 to $106,414;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The expansion of the Tacolcyl/ 12th Avenue Parks' Project
by increasing the scope of the Tacolcy Center portions of the Project
thereby bringing the total project development budget to $1,209,732 is
hereby approved.
1/ The acronym "Tacolcy" stands for "The Advisory Committee of Liberty
City Youth.".

Section 2. The City Manager is hereby authorized to execute the
attached agreement amending an original agreement dated June 13, 1977,
between the City and Johathan G. Seymour, Henderson -Rosenberg Associates,
and David M. Scully and Associates for their professional services in the
design and development of Tacolcy - 12th Avenue Parks with the proposed
amendment calling for a revised consultants' design fee in the amount
of $106,414 hereby allocated from the Parks for People Bond Fund.

This Supplemental Agreement made this 1"1�vyydaY of
1979, amending the Agreement dated „Chine 134_^I92.7 by
and between the City of Miami, a Municipal Corporation of the State
of Florida, hereinafter called CITY, and Jonathan G. Seymour, 5942
S.W. 73rd Street, South Miami, Florida, and Henderson -Rosenberg
Associates, 6333 Sunset Drive, South ttiami,Florida, and David M.
Scully and Associates, 5900 S.W. 73rd Street, South Miami, Florida,
hereinafter called CONSULTANT.
W ITNESSETH
THAT, WHEREAS, the CITY and the CONSULTANT entered into an
Agreement on June 13, 1977-for the design and development of Tacolcy
Park and 12th Avenue Park with a project development budget of
$300,000, plus a fixed fee of $82,700 for consultant design services,
and
WHEREAS, the CITY wishes to expand the project construction budget
from $800,000 to $1,010,000; and
WHEREAS, the increase in the project construction budget, will
rcuirc an increase in the CONSULTANT'S fixed fee from $82,700 to
$106,414;
t10b7, THEREFORE, the CITY and the CONSULTANT for the consideration
hereinafter set forth agree and covenant one unto the other that the
Agreement entered into between the CITY and the CONSULTANT dated
June 13, 1977, is amended as follows:
SECTION T - GENERAL
B. The CITY shall pay the CONSULTANT for professional and
technical services a FIXED FEE of $82.708 $106,414.
SECTION IIT - PROFESSIONAL SERVICES
(Third paragraph) The total PROJECT development COST including
the fee for professional and technical services and site
development is $48474HA $1,209,732.
SECTION V - COMPENSATION FOR SERVICES

(Last paragraph) In the event that the total PROJECT
development budget of 4882T494 $1,209,732 is increased
by more than 1O% by the CITY at any time up to the approval
of the final CONTRACT DOCUMENTS, the CITY !nail compensate
the CONSULTANT for the additional work required, by negotiation
of a reasonable fee in addition to the FIXED FEE of $42,490
$106,414 as set forth above.
IN WITNESS, THEREFORE, the parties hereto have individually
and through their proper corporate officials executed this Supplemental

Tacolcy-12th Avenue Parks
Supplemental Agreement
and Ordinance Amendment
Enclosed are the supplemental agreement, the resolution and the
ordinance amendment necessary to amend the Tacolcy-12th Avenue
Parks agreement between the City and Seymour, Scully, Henderson
and Rosenberg, and provide funds for various aspects of this
project.
The original increase in this fund from S1,114,200 to S1,324,200
was occasioned by increasing the construction budget by $210,000.
This action was approved by the Tacolcy Board and the Model City
Community Development Task Force, and was included in the 1978-79
CIP.
However, the S210,000 included in the CIP does not include funds for
the increase in the consultant's fee of $23,714 as approved by you
on November 27, 1978.
Additionally, no funds were ever allocated to pay the Department
of Public 'Works or the Park Design Division for any of the costs
incurred by this project. We are estimating charges of 370,700
(7 of the S1,010,000 construction budget) for the Department
of Public Works, and $22,613 (2.25. of the S1,010,000 construction
budget) for the Park Design Division, for an in-house total of
S93,313.
The City recently received a bill for $331,205 from Dade County
for the acquisition of land for Tacolcy-12th Avenue Parks. This
bill exceeds the $231,500 set aside for acquisition in the CIP
by $99,705 (rounded to S99,200). Therefore, this S99,200 will
also have to be deducted from the Parks for People District III
funds.
