HomeMy WebLinkAboutR-79-02583-12-79 GMM:S/2 RESOLUTION NO. 79-258 A RESOLUTION APPROVING THE VACATION AND CLOSURE OF THE ALLEY BOUNDED BY BRICKELL PLAZA, BRICKELL AVENUE AND S.E. 8TH STREET APPROXI- MATELY SOUTH OF THE SOUTH RIGHT-OF-WAY LINE OF S.E. 8TH STREET FOR A DISTANCE OF + 245.5' AS PER TENTATIVE PLAT #1040, "INTERCAP SUB". WITH THE STIPULATION THAT THE EXIT BE REVERSED AT HIGH PEAK HOURS OF TRAFFIC ON A DAILY BASIS. WHEREAS, the Miami Zoning Board, at its meeting of March 5, 1979, Item #1, following an advertised hearing, adopted Resolution No. ZB 40-79 by a 5 to 2 vote recommending approval of the vacation and closure of the alley bounded by Brickell Plaza, Brickell Avenue and S.E. 8th Street approximately south of the south right-of-way line of S.E. 8th Street for a distance of + 245.5' as per Tentative Plat #1040, "INTERCAP SUB"; and WHEREAS, two objections to said vacation and closure were received in the mail, and two objectors were present at meeting; and "DOCUMENT INDEX .TE�IQ 17 WHEREAS, the City Commission deems it advIisa the best interest of the general welfare of the City of Miami and its inhabitants to grant said approval; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The vacation and closure of the alley bounded by Brickell Plaza, Brickell Avenue and S.E. 8th Street approximately south of the south right-of-way line of S.E. 8th Street for a distance of + 245.5' as per Tentative Plat #1040, "INTERCAP SUB", be and the same is hereby approved. with the stipulation that the exit be reversed at high -peak hours of traffic on a daily basis. EXPLANATION The alley closure is needed to consolidate the land for a proposed office building project. RECOMMENDATION PLANNING DEPARTMENT APPROVAL IN ACCOP:J WITH THE PLAT COMMITTE'S CONDITIONS OF APPROVAL. The alley closure will not impair vehicular or pedestrian circulation since traffic will be rerouted onto SE First Avenue (Brickell Plaza). We understand that the Caribbean National Bank has planned and designed a structure fronting on Brickell Avenue, and with rear access from the alley, with anticipation of the continued functioning of this public way in its present location. We have inspected the site and surroundings in the field, and have made certain traffic counts to assist in our eval- uation. We have examined a large scale outline plan of the block surrounded by Brickell Avenue, S.E. loth Street, S.E. 1st Avenue, and S.E. 8th Street. This plan shown existing and proposed construction within the block and also shows the alley turned westward at approximate mid -block to a new inter- section with S.E. 1st Avenue. Proposed private construction covers the present public right-of-way north of mid -block. Our inspection shows that there is, and has been for some time, a pattern of usage of the alley which delivers vehicles to parking facilities either within or to the rear of the pre- 79-253 ALLIANCI. Jordan Page Two sent buildings fronting on Brickell Avenue on S.E. lst Avenue. Thus, although the service functions of an alley are often its predominant mission, in this case usage for vehicular access in the same manner as any public street is a clearly established pattern of public service. Auy proposed changes, therefore, should be examined in the light of consequences to the public and to adjoining owners and users. We find that there are potential consequences to relocating this public right-of-way which are contrary to the best inter- ests of present users, adjoining properties and the general public. • In its present position there is dIrect access to S.E. loth Street and S.E. 8th Street. These are principal east -west arteries. A relocation to S.E. lat Avenue would impose unaccustomed extra traffic on S.E. 9th Street, and on S.E. 1st Avenue. • A new intersection on S.E. 1st Avenue would generate undesirable friction from the six adjacent lanes (existing and proposed) serving two parking garages and the drive-in teller exits. As S.E. let Avenue is two-way, dangerous crossing traffic would ensue, resulting in delays awaiting clearances, and in the potential for accidents. • The proposed plan would concentrate eight lanes of entering and exiting traffic within a apace of 140 feet. This is undesirable congestion, achieved through clearances which are contrary to good practices and many codes. Sm;g and .Asian, 79-258 Mr. G. W. Jordan Page Three In addition to the above short term consequences there are long term transport related matters which should not be overlooked, and the proposed relocation has the potential for unduly complicating design, operation and capital construction costs. The Dade County Office of Transportation Administration is pursuing energy efficient modes of urban► transit. Among these is the automated transit system known as a People Mover. This is to be a key complementary circulation system to the heavy rail mass transit system now under design and imminent start of construction. As a result of intense planning and studies the approved route for the People Mover is set along S.E. 1st Avenue between S.E. loth Street, and S.E. 8th Street, continuing north- ward to the present Miami CBD. There is a station to be set at S.E. 8th Street. As the People Mover will be on an aerial guide- way, supported by heavy girders and piers, and pier placements must provide for the flow of surface traffic, and also be set for economical construction, any concentration of driveway traffic, and any new intersection, poses special design and con- struction problems inhibiting the use of the more economical standard length girders and piers. Relocating the alley adds extra traffic to the People Mover equation. It is our opinion that the best interests of the general public would be served by not relocating the alley. In addition, the proposed relocation would subject occupants of the proposed Caribank Building to traffic delays and hazards not associated with access through its present position.
