WlitRtAS, taxicabs are particularly vulnerable to robberies and thereby subject taxicab driverg to great personal and physical danger; and WHEREAS, it is physically impossible to provide complete continuous police protection to cab drivers; and WfltRtAS, cab driver associations have declared their belief that a bullet -resistant partition separating the passenger area .• from the driver area of their taxicabs would provide significant protection for the personal safety of the taxicab driver; NOW, THEREFORE* DE IT ORDAINED BY THE COMMISSION OP THE CITY OF MIAMI, FLORIDA: Section 1. Section 56-30 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particu- 1/ lars: "Sec, 56-30, Requirements for vehicles, * * C.(1) Each taxicab which is o erated under a certi ioate issuedbyie TiJclay s a have the ollowing equipment; (i) Except as provided in .subsection (ii) of aragra h C. The sign or decal shall contain' the following in red luminous letters 1/2 inch in height: THIS PARTITION IS BULLET RESISTANT. (3) (i) It shall be unlawful for any person to operate or permit anyone to operate any taxicab for which a certificate has been issued by the city without said vehicle being equipped with a protective plate or partition as set forth herein. (ii) It shall be unlawful for any person to operate or permit anyone to operate any taxicab for which a certificate has been issued by the city without said vehicle displaying the herein described decal or sign." (4) Any taxicab which is exclusively driven by the owner thereof under a certificate issued to said owner shall be exempt from the requirements set forth in all of the provisions of paragraphs c(1), (2) and (3) hereof. Section 2. Aliordinances; code sections or parts thereof in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. If any section, sentence, clause, phrase, or word of this,ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such invalidity shall not affect the remaining portion of this ordinance. ves4.11 e • v.; ". 1- Section +.
