WHEREAS, Southeast Properties, Inc.,, the owners of certain property located between Secoffee Street and U.S. 1,,(State Road No. 5), lying east of S.W. 22nd Avenue in the City of Miami, deeded to the City of. Keyes Building Corp. 'its successors in interest and/or assigns does hereby agree with CITY:; as follows: said 79-346 Keyes Building Corp. shall submit to the Department Public Works acceptable plans and specifications for approval prior to the construction of, and as built drawings of utility connection services under and across said City of Miami property. Keyes Building Corp. shall obtain from all governmental 'agencies the required and necessary permits and approvals for the construction of said utilities. Keyes Building Corp. assumes all responsibility holds tlie City harmless, and agrees to be responsible for, any damage or claim which may be brought as a result, either directly or indirectly, from the existence, construction, operation, maintenance,, repair and/or removal of said utilities. Keyes Building Corp. agrees to bear all costs and to perpetu- ally maintain the trees, grass and landscaping on said City property to 'a standard acceptable to the City, and to land- scape the City property in a manner comparable `to that' which is. initially installed in conjunction with the development of Lot 6Block 1, ; DeWitt Sub. (-1-) It is expressly agreed that this instrument and obligation be bindingon Keyes Building Corp., its successors in interest or assigns and that this Agreement will be recorded in the Public Records of Dade County, Florida, and shailbe a condition implied in any conveyance or other instrument affecting the title to Lot 6,.Block 1, DeWitt.
