The City Manager is hereby authorized to execute the attached agreements with the Dade County School Board for funding the continuation of the Dade County Community Schools Program and its After -School Care Program through September 30, 1979, subject to the availability of funds tobe appropriated from Anticipated Miscellaneous Revenues, Sources Ad Valorem Tax. May 22, 1979 The attached resolution authorizes the City Manager to enter into, contractual agreement with the Dade County Community Schools for $70,000.00"nand Dade County, After School Care Program for $192,017.00. The period; of the above mentioned agreements will be October 1, 1978 to September 30, 1979. DS/db ENTS - 4 ,REEMENT FOR USE OF CITY OF MI' FEDERAL REVENUE SHARING FUNDS FOR ENTITLEMENdT PERIOD October 1 1978 to September 30, 1979 THIS AGREEMENT, entered into by and between the City of Miami, a political subdivision of the State of Florida, hereinafter referred to as the "City', and The School Board of Dade County, Florida, hereinafter referred to as the "Agency", having its principal office at 1410 N.E. 2nd Avenue, Miami, Florida 33132, this day of , for the period beginning October 1, 1978 and ending September 30, 1979. PURPOSE AND OBLIGATIONS 1. Purpose of Agreement The purpose of this Agreement is to state the covenants and conditions under which theAgency is to continue Community School Programs at: Fairlawn Elementary School, 444 S.W. 60th Avenue, Miami, Florida 33144 Miami Northwestern Sr. High, 7007 N.t1. 12th Avenue, Miami, Florida 33150 Kinloch Park Jr. High, 4340 N.W. 3rd Street, Miami Florida 33126. Primary "C" School, 757 N.W. 66th Street, tliami, Florida 33150 Little River Elementary. School,:514 N.H. 77th Street, Miami, Florida 33150 Shadow:lawn Elementary School, 149 N.W. 49th Street, Miami,. Florida 33127 Silver Bluff Elementary School, `2609`S.W."25th`Avenue, `Miami, Florida 33133 Riverside Elementary School, 221 S.W. 12thAvenue, Miami, Florida 33130 Dunbar Elementary School, 505 N W."20th Street, tliarni, Florida 33127 and providefor additional program support funds for the above mentioned nine schools and three additional community school programs already cosponsored,by the City of Miami. at Miami Edison Senior High School, Allapattah Junior High: School and Ada Merritt Junior High School. . Obligations of Agency "SUPPORTIVE DOCUMENTS FOLLOW" The Agency agrees and understands that the agreement should be completed and approved within 90 days of appropriation. Failure to comply gives the City the right to withdraw, and reappropriate funds. The Agency agrees to carry, out the project as described in its attached work program in a lawful, satisfactory, and proper manner, and in accordance, with the written policies, procedures, and requirements as prescribed in this agreement and as set forth Eby the United States Secretary of the Treasury, the Office of Federal Revenue Sharing and the City of Miami. ; The Agency shall not perform in a way incon- sistent with the terms of the work program except as authorized in writing by the City. Such authorization by the City shall be subject to and in accordance with prescribed guidelines. . Compliance with Local Laws Both parties shall comply with all of the State and local government. . Contract Modification applicable laws, ordinances, a d codes The City or the Agency may, from time to time, request changes in the scope of the services to be performed hereunder. Such changes, including increase or or decrease in the amount, of Agency compensation, which are mutually agreed upon by and between the City and the Agency must be incorporated in written amendments to this agreement, following approval thereof by the City Commission. (A description of the Agency's project work program is attached hereby incorpo- rated and made a part of this Agreement as Exhibit A.) 79-339 PART III COMPENSATION METHOD, CONDITIONS OF PAYMENT AND TIME OF PAYMENT 1. Maximum Compensation The. Agency agrees to accept as full payment for, services rendered in a manner satisfactory to the City, the actual amount of budgeted, eligible, and City approved expenditures and encumbrances made by the Agency for the purpose of carrying out the services hereunder during the period of this Agreement. It is expressly understood and; agreed that in no event shall the total compensation and/or reimbursement to be paid hereunder exceed the maximum sum of$70,000.. Budget Summary The budget summary attached hereto is hereby incorporated and made a part of this Agreement. Funds may not be shifted by the Agency within and between line items of the budget without approval of the City. Adjust- ments.in the work program amendments thereto, or revision: thereof, as .. may hereafter be prepared, shall by effective for any purpose unless and:, only to the extent concurred in by the City and consistent with applicable federal regulations and guidelines. Payment Upon• executi on of this agreement and with a written request from the Agency, the City shall advance the sum of $45,000 of the appropriated funds to. the Agency for the co-sponsorship of community schools. All payments thereafter shall be reimbursements for expenditures incurred, and in compliance with a previously approved line item budget. Such written request shall contain a statement declaring and affirming that all disbursements were made in accor- dance with the approved budget. The Agency warrants that no person or selling agency or other organi- zation has been employed or retained to solicitor secure this, contract upon an agreementor understanding for a commission, percentage, broker- age, or contingent fee. For breach or violation of this warrant, the City shall have the right to annul this contract, or otherwise recover the full arnount of such commission, percentage, brokerage, or contingent fee, or to seek other remedies as legally may be available. At any time or times prior to final payment under this contract the City may have the Agency's financial records audited. Each payment theretofore made shall be subject to reductionfor amounts included in the related invoice: or voucher which are found by the City Manager, on the basis of such audit, not to constitute allowable allowablecost. Any payment may be reduced for payments,` or increased for underpayments, on preceding invoices or vouchers. Subcontracts None of the work or services including, but not limited to, consultant work or services covered by this contract shall, be subcontracted with- out the prior approval of the City. Any work or services subcontracted. hereunder shallbe specified by written contract or agreementand shall be subject to each provision of this contract. Proper documentation in accordance with the Office of Federal Revenue Sharing and City guidelines must be submitted to and approved by the City prior to the execution of any subcontract hereunder. Reports, Audits, and Evaluations The City shall cooperate with the Agency in the conduct of activities delegated under this contract as reasonably requested. The Agency r`/g ca. agrees to submit toCity rathe such reports as y be required by the Secretary of the Treasury, by the Office of Federal Revenue Sharing and a quarterly report to the City comparing expenditures to the approved budget. The agency also agrees to prepare and retain and permit the City to inspect as it deems necessary for grant purposes records that may be relevant to Federal, State, or local directives. The Agency further agrees that the City may carry out monitoring and evaluation activities to include at a minimum. visits and observations by the City staff and will effectively insure the cooperation of the Agency's employees and board members in such, efforts. Whenever reports, forms, etc., are required of the Agency herein, 15 days prior notice in writing of such shall be provided wherever possible. The Agencyshall. preserve and make available its records until the expiration of three years from the date of final payment under this contract and for such longer periods, if any, as is required by applicable Federal, State, or local laws. Obligations to Upon termination of this agreement, the agency agrees and understands that the City has no obligation to refund any Agency or program with it's Federal, Revenue Sharing funds. Time of Performance This contract shall become effective upon execution,. and the services off the Agency-are"to, commence as soon as. practicable after execution and shall be" undertakenand completed in light of the purposes of this contract; but in any' event" all. services' required hereunder shall be completed by September 30', 1979. PART IV; GENERAL CONDITIONS 1. Restrictions on Use of Funds No funds received under this, contractmay be used directly or indirectly; as. a contribution in order to obtain,anY federal funds under any federal Pro- gram. The indirect use of Revenue Sharing Funds to match federal funds is defined to mean the allocation of Revenue Sharing Funds to a non -matching expenditure thereby releasing or, displacing Agency funds which are used for the purpose of matching federal funds. This prohibition on the use of Revenue Sharing Funds as matching; funds applies to federal programs where federal funds are "requiredto be matched by non-federal funds and the federal programs which allow matching from either federal or non-federal funds. . :Equal opportunity The Agency agrees that there will be no discrimination against any employee •or person served on account of race, color, sex, religious creed, ancestry, or national origin in its performance of this contract and it is expressly understood that upon the receipt of evidence of such discrimination, the City shall have the right to terminate this contract. Conflict of Interests No official or employee of the Agency may be admitted directly or indirectly to any share or part of this contract or to any benefit to arise from the same nor own or acquire any personal interest in any property,.contract or proposed contract which would conflict with or relate to the performance,. their 'duties "or<responsibilities under this contract. If any suchperson presently or in the future acquires, owns, or controls any such share, benefits, or personalinterest, he shall ,immediately disclose such share, benefit, or personal interest to the City. Upon such disclosure such person shall not continue his participation unless it" is determined by the City that his participation is not contrary to public interest. The Agency`s" will comply. with all Federal, State, and local conflict of interest laws and requirements. 79-339 ■ i i 1 4. Termination The City, bygiving reasonable written notice specifying the effective date, may terminate this contract in whole or in part for cause which shall include: (1) Failure, forany-;reason,. of the Agency toy fulfill in a timely and proper manner itsobligations under this contract including compliance. with the approved work program `and attached. conditions andsuch directivesasmay, become generally applicable atany time,-�(2) Sub- mission byythe .Agencyto the Cityof:reports that are incorrect or.incom- pletein any material respect, and (3�) Ineffective or improper use of funds provided under this contract. IN WITNESS WHEREOF, the parties hereto have caused this Agree- ment to be executed in their names by their duly authorized officers and the corporate sealsto be affixed hereto, all as of the day and ,year first APPROVED AS TO FORM f' Attorney for Board APPROVED AS TO FORM AND CORRECTNESS: DADE COUNTY, FLORIDA -4- EXHIBIT A WORK PROGRAM 1 of 2 During the period beginning October 1, 1978 through September 30, 1979, the Comntunity School Program shall provide central coordination for recreation, cultural, and coninunity activities to residents of the City of Miami through the nine Community Schools enumerated in this agreement. The Community Schools will provide recreation services to residents at several convenient community locations. These services shall be provided in the City of Miami for the benefit of City residents. The agency will provide Programs and activities of a recreational, cultural* and enrichment nature for persons of all ages. The activities encourage community participation and involvement in the schools. In addition, the Conimunity School Program seeks to maximize the use of existing physical and human agencies, with volunteer and civic service organizations, with business and industry, and with other institutions. Activities offered at Community Schools vary from school toschool depending upon the CammunitY• Activities are open to people of allages (children, teens, l adults, and senior citizens) without reference.to race, color, creed, or national origin. • Specific activities.and programs being provided...be:ill s inRecreational and social - various dance activities, bri.dge,.ceramic , oil painting, arts and crafts, bike hikes' group Ul; .41\ ‘i games, seasonal sports, tumbling, teen clubs, F:OLLOV\I" fitness clubs, etc. Cultural - choral groups, piano, music appreciation clubs, dramatics, concerts, lectures, literary clubs, etc. Farnily - father and son and mother1 and daughter activitiessfilm clubs, famsleyriesfamily , town hall meeting , bike rodeos, fitness clubs,hobby clubs, etc. Coinmunity projects - lecture safety Programs, coinmenity clean-up Progra91ns.s , etc. 79 City of Miami of 2 Funds will provide for: Continuation of the co-sponsorship for thenine schools now co -sponsored by the city through federal revenue sharing funds ($45,000) Providing additional program support .funds for.eac program co -sponsored, by the city ($25,000).,' Programs support funds will be used to employ Part-time hourly staff a the community schools inthe City of.
