He ORDINANCE NO. .3.1.118 AN ORDINANCE AMENDING SECTIONS 1 AND 6 OF ORDINANCE NO. 8858, ADOPTED SEPTEMBER 28, 1978, THE ANNUAL APPROPRIA- TIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1979,AS AMENDED; 8Y INCREASING THE APPROPRIATIONS FOR THE GENERAL FUND, POLICE DEPARTMENT, IN THE AMOUNT OP $51.302; BY •INCREASING ANTICIPATED REVENUES, SOURCES OTHER THAN AD VALOREM TAX, IN THE SAME AMOUNT; PROM THE STATE OF FLORIDA FOR THE OVERTIME tXPENSES OF A SPECIAL INVESTIGATION; CONTAINING A REPEALER PROVISION An A SEVERABILITY CLAUSEt AND DI8PENSINO WITH THE REQUIREMENT Ot' READING SAME ON TWO SEPARATE DAYS BY A VOTE or NOT LESS THAN VOUR-PIPTHS OP THE MEMBERS or THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 8858 OM September 28, 1978, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 50, 1979; and WHEREAS, the City of Miami Police Department in conjunction with the State Attorney's Office, conducted a major drug investigation in the City of Miami; and WHEREAS, overtime expenses were incurred by the Special Investiga- tion Section during the period November 18, 1978 through May 19, 1979, for the purpose of said investigation; and WHEREAS, the State Attorney's office agreed to reimburse the City of Miami for the overtime expenses amounting to $51,392; and WHEREAS, four (4) checks in the total amount of $48,979 have been received from the State of Florida as reimbursement for the aforementioned expenses; and WHEREAS, a remaining balance of $2,413 is due from the State of Florida to make up the total of $510392; and WHEREAS, the amount of $51,392 can be appropriated into the General Fund, Police Department, for said expenses; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF •MIAMI, FLORIDA: • , - Section 1, Sections 1 and t Of OrdinanCe NO. 8868, Wilted Septa* ber 28, 1978, •as amended, are hereby further •amended in the follOwing partiCU- lart 1/ "Section 1. Gary% Director Al" Management and Budget Proposed Ordinance to Appropriate Overtime txpentet for Police Depart- ment • The Police Department has received four (4) checks from the State of Florida totaling $48,079 at reimbursement for overtime expenses. These expenses were incurred as the result of a highly confidential investigation in the Special Investigation Section for which the State Attorney's Office agreed to reimburse the City of Miami Police Department for overtime costs. The total costs for overtime expenses for the period from November 18, 1978 through May 19, 1979 was $51,392. The remaining balance of $2,413 will be forthcoming as soon as it is processed by the State of Florida. These funds represent expenditures for overtime for the week ending November 10, 1978 through the week ending May 19, 1979. It should be noted that these funds are being forwarded on a partial basis with the remaining balance of $2,413.31 due to be received upon being processed by theState of Florida. Mr. Howard Gary, the Director of the Department of Budget and management, has been contacted on this date and assured us that his office will+.prcpare an ordinance to. replace these funds into. the Miami Police Department's General Fund Overtime Account.
